No problem at all. Congratulations on your purchase.
The setback for accessory structures like a deck is 35 feet from the wetland resource area. Expansion of the deck within
that area would require a variance form the bylaw regulations. Such a variance is not commonly issued by the
Commission. If mitigation plantings are proposed to provide a better buffer to the wetland then sometimes some
encroachment into the setback may be allowed. Such projects are reviewed on a case-by-case- basis.

I recently purchased the property at 54 Breezy Point Road. I know the owner was before Conservation last week to get
the Certificate of Compliance squared away and he has shared with me the good news that the Certificate of Compliance
was issued. I want to thank you personally for handling that in such a prompt fashion.
I am wondering what the conservation rules are for building a deck and/or stairways(with footings), or balcony in my
back yard which is close to the marsh (about 20 +/- feet away). You may have walked the property and saw that there is
an existing deck and stairway that exists in the area of the foundation that jogs in, however, if one wanted to expand the
deck in the back yard to either the left or right side of the house, I would like to know what would be allowed. There is
one side of the rear of the house that is much closer to the marsh then the other side, I would like to know what is
allowed in that area also.
