to the the south by Lewis Bay and to the east and north by residences. Resource areas that affect
the site include: coastal bank and land subject to coastal storm flowage (VE el 13, VE el 12 and AE
el 11)

Request for Determination
194 Berry Avenue
West Yarmouth
Introduction
Current site improvements include a 5 bedroom non-floodzone compliant dwelling, with Title 5 septic system
installed in 2001. The original house was constructed in 1930 according to the assessor's records, with
improvements since then. No alterations to the leaching facility are expected as there is no increase in flow
over what exists.
The following work is proposed:
• Construction and structural improvements to the foundation under a portion of the dwelling
• (Partial) new framing and repairs
The resource areas which affect the site are Land Subject to Coastal Storm Flowage (AE el. 12, AE el. 11, and
VE el. 13) and Coastal Bank. The work will occur within the 100 year flood elevations of 11 and 12 and lies
within the Buffer Zone to the Coastal Bank, a man-made rock seawall recently upgraded.
The site was surveyed by Down Cape Engineering, and the topography is based on the current NAVD '88
flood zone datum. All work occurs within Land Subject to Coastal Storm Flowage (LSCSF). No fill is
proposed.
A construction protocol by Capewide Construction is enclosed as part of this filing, indicating the construction
sequence and work details.
Compliance with the MA Wetlands Protection Act and Yarmouth Bylaw Chapter 143 Regulations:
The proposed construction activities will not have a deleterious effect upon any wetland values as listed in the
Bylaw. A silt fence is proposed to contain construction activities. The site is mostly level; no erosion threat is
expected. The alterations within a resource area (LSCSF) involve primarily the western portion of the
dwelling, and will be less than 50% of the linear length of the foundation and allowable under FEMA
regulations. Roof drainage will be handled either using downspouts to drywells or roof driplines to stone
trenches. All run-off shall be contained on-site. A work limit line is proposed between the Coastal Bank and
the dwelling, as well as along the westerly property line.
Outside of the dwelling, the site consists mainly of lawn area and a paved driveway. Any required staging of
materials will take place in the area closest to the road and furthest from the wetland area.
RARE SPECIES
The site is not located in a Priority Habitat or Estimated Habitat for state -listed rare species as shown on Mass.
GIS Oliver Maps dated 2017.
ALTERNATIVES ANALYSIS
The alternative would be to leave the house as -is, which is unacceptable as structural repairs are necessary
for the foundation. The proposed repairs are an improvement over existing conditions.
