Subject RE: From Anthony Alva - Re- 9 Pinewood Road West Yarmouth Inspection List
Dear Attorney Alva:
If you recall I stated during the ZBA hearing, that based on the Assessors' records, it appeared the former owner created
the two bedrooms. Their creation is not in question. What is in question, is whether they were created lawfully. Is a
matter of fact you and I reviewed the file and discussed the issues prior to the ZBA hearing, in the hallway outside the
hearing room. You also cited many of the issues I had provided you with during your presentation to the Board.
This department has reviewed the physical documents and the electronic(scanned) documents several times and they
are identical. In doing so we find no substantiation to your suggestion that the bedrooms were created with permits.
To reiterate what we have put in writing and stated verbally, your client and the former owner performed work and/or
had work performed without permits. If you wish to obtain file copies you can obtain same from the Town Web Site.
Finally, in order to commence the process of remediation, it is imperative your client address all the issues noted in June
19,2019 letter, immediately.
Respectfully,
James D. Brandolini,
Deputy Building Commissioner

Dear Mr. Brandolini:
It is our understanding that 9 Pinewood was, and always has been a 4 bedroom home, going back until the time before
my client purchased the home. The realtor from whom they purchased, Mr. Dick Martin, notified my client that it had
been a lawful four bedroom for years, and that he had been the property manger back then. I called and spoke with Dick
and he said he could speak with you about the historical use of the home.

Therefore,we believe the permits were originally obtained when required, and would ask that you research the file one
more time. Also this is my request for a complete copy of the file.We note that there is not evan an as-built plan,or
plans or permits(for electrical and other woe)to even contract the building-they are not on-line..
Thanks! Sincerely,
Anthony Alva, Esq.
