Greetings:
This morning, I responded to a complaint, forwarded from the Town Administrator's
office, regarding a build up of debris in the yard area behind 36 Camp Street.
Upon arrival, visible from the street, I could see what appeared to be a pile of mattresses,
or furniture. A closer examination revealed not only mattresses and furniture, but also
other items dumped haphazardly in the area behind your dwelling. Some of these items
were found in a boat on a trailer adjacent to the pile.
Enclosed, please find copies of regulations from the State Sanitary Code related to
storage and removal of rubbish, trash and related items as well as maintenance of
properties. The items mentioned above must be removed from the property and properly
disposed of within a period of 14 days. The boat and trailer may be kept, but the contents
of debris inside the boat itself must be disposed of as well.
Additionally, it is necessary for you to schedule anpection of the dwelling prior to any
room rental permit issuance for calendar year 211, 3tease call the office to schedule.

410.600: Storare of Garbage and Rubbish
(A) Garbage or mixed garbage and rubbish shall be stored in watertight receptacles with
tight-fitting covers. Said receptacles and covers shall be of meal or other durable,
rodent-proof material. Rubbish shall be stored in receptacles of meal or other durable,
rodent-proof material. Garbage and rubbish shall be put out for collection no earlier than the
day of collection.
(B) Plastic bags shall be used to store garbage or mixed rubbish and garbage only if used
as a liner in watertight receptacles with tight-firing covers as required in 105 CMR
410.600(A). provided that the plastic bags may be put out for collection except in those
places where such practice is prohibited by local rule or ordinance or except in those cases
where the Department of Public Health determines that such practice constitutes a health
problem. For purposes of the preceding sentence,in making its determination the Department
shall consider. among other things, evidence of strewn garbage, torn garbage bags, or
evidence of rodents.
(C) The owner of any dwelling that contains three or more dwelling units,the owner of any
rooming house, and the occupant of any other dwelling place shall provide as many
receptacles for the storage of garbage and rubbish as are sufficient to contain the
accumulation before final collection or ultimate disposal. and shall locate them so as to be
convenient to the tenant and so that no objectionable odors enter any dwelling.
. (D) The occupants of each dwelling,dwelling unit,and rooming unit shall be responsible
for the proper placement of his garbage and rubbish in the receptacles required in 105 CMR
410.600(C)or at the point of collection by the owner. •
410.601: Collection of Garbage and Rubbish
The owner of any dwelling that contains three or more dwelling units.the owner of any
rooming house,and the occupant of any other dwelling place shall be responsible for the final
collection or ultimate disposal or incineration of garbage and rubbish by means of:
(A) the regular municipal collection system:or
(B) any other collection system approved by the board of health: or
(C) when otherwise lawful. a garbage grinder which grinds garbage into the kitchen sink
drain finely enough to ensure its free passage.and which is otherwise maintained in a sanitary
condition; or
(D) when otherwise lawful. a garbage or rubbish incinerator located within the dwelling
which is properly installed and which is maintained so as not to create a safety or health
hazard; or
(E) when otherwise lawful.by backyard costing of compostable medal,provided that
the composting operation does not attract rodents or other vectors and does not create a
nuisance.and provided further that in the case of composting by an occupant.the occupant
obtain the prior written permission of the owner.
(F) any other method of disposal which does not endanger any person and which is approved
in writing by the board of health. (See 105 CMR 410.140.)
410.602: MaintenanCcni Areas Free from Garbage and Rubbish
(A) La The owner of any parol of land,vacant or otherwise. shall be responsible for
maintaining such parcel of land in a clean and sanitary condition and free from garbage.

of the occupants of any dwelling or of the general public.
(B) Dwelling Unite The occupant of any dwelling unit shall be responsible for maintaining
in a clean and sanitary condition and free of garbage. rubbish. other filth or causes of
sickness that part of the dwelling which he exclusively occupies or controls

Thank you for alerting us to this problem. I visited the property today and was able to view the debris.
I have issued the property owner correction orders calling for the removal within 14 days.
This department will follow up on this as needed.

Dear Mr. Lawton-
I wasn't sure where to start or who the proper person was that I should be contacting in regards to this matter,
so after talking with my co-worker Kim Gomez, she told me to email you with the problem and you would be able
to contact the proper person.
Our problem, once again, lies in the trash issue in the back yard of 36 Camp St.,West Yarmouth (we are
abutters). Over the last 3 years the pile has grown to now include an old boat that is full of more trash !!! This pile
includes everything from discarded mattresses to windows (now a prime target for the neighborhood kids), old
fencing and boards,to just about any kind of household furnishing you can imagine...not sure if the kitchen sink is
there as I don't want to get that close. A few years back, I called in a complaint as there were "critters"that were
bedding down in the trash heap and as Spring is hopefully just around the corner, I'm hoping to get this issue
taken care of in advance.
My husband and I would appreciate any help you could give us with this matter! We were hoping when we
saw a few truckloads taken out last year that it would be resolved on it's own but more was dumped in it's place
since then so we feel this is the only solution. Thank you in advance for your time ... Linda& Richard Duffy
