(BSC) is pleased to submit this Notice of Intent (NOI) Application on behalf of Mark Haggerty (the Applicant) for the property located at 12 Jessie’s Lane, South Yarmouth, Massachusetts (the Site). The project consists of the in-kind replacement of an existing boathouse, including nine existing support pilings, located along the bank of the Bass River. The existing dimensions and location of the boathouse and pilings will be maintained. For more information, please refer to the attached Site Plans and Project Description. Applications must be submitted two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioner’s packet a week before the meeting. Failure to follow the Administrative Checklist guidelines shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Project Description Notice of Intent 12 Jessie’s Lane South Yarmouth, MA PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project at 12 Jessie’s Lane, in South Yarmouth (the Site) involves the in-kind replacement of an existing boathouse, along with the replacement of all existing support pilings. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. 2.0 SITE DESCRIPTION The property located at 12 Jessie’s Lane, in South Yarmouth, is bordered by single-family homes to the east and west. The property is bordered by Bass River to the south. The wetland resource areas and areas of conservation jurisdiction on or adjacent to the Site, that are protected under the Wetlands Protection Act and the Town of Yarmouth Wetland Protection Bylaw include:  Land Under Ocean  Shellfish Habitat  Riverfront Area (Bass River)  Coastal Beach  Coastal Bank  Land Subject to Coastal Storm Flowage - FEMA Flood Zone VE (elevation 13), FEMA Flood Zone AE (elevation 11) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: Raze and Replace Existing Boathouse: The proposed project involves the in-kind replacement of an existing boathouse, as well as the support pilings, located on the bank of the Bass River. The proposed replacement boathouse will be in same size and will be located in the same location as the existing boathouse. Therefore, no new impacts to RFA, Coastal Beach, Land Subject to Coastal Storm Flowage or other adjacent Resource Areas are anticipated. The proposed replacement pilings will serve as the structure’s foundation. This has become necessary as the existing pilings used to support the boathouse have been compromised and can no longer be used. The replacement treated wood pilings will be in the same approximate location as the existing pilings supporting the boathouse. 4.0 ALTERNATIVE ANALYSIS No-Change Scenario In this scenario, the project would not go forward. The boat house would remain in the same location and still be supported by damaged pilings. Continued use of the boat house would not be safe, as the integrity of the foundation is compromised. The current structure sits within Land Subject to Coastal Storm Flowage, Coastal Beach, and is at the edge of the Bass River, making it susceptible to storm damage and having the potential to damage adjacent structures if it were to be impacted during a storm event. Proposed Scenario The proposed project consists of the in-kind replacement the boathouse and of all support pilings. This would increase the safety of the boathouse for use by the applicant. This would also benefit Notice of Intent 12 Jessie’s Lane South Yarmouth, MA the surrounding resource areas in that the structure would be less likely to be damaged by storm events, which could dislodge parts of or the whole structure, sending debris into the River or abutting properties. 5.0 MITIGATION Access for this project will be gained from the upland portion of the site. The existing boathouse and pilings will be demolished, with all removed structural components and debris placed in a roll-off container stationed in the upland. Any debris getting into the resource areas will be removed as soon as possible. Work will be conducted from upland areas using machinery to remove existing pilings and install new pilings. No permanent impacts to resource areas are anticipated as a result of this work. Once the project is completed all disturbed areas of lawn will be loamed and seeded and previously approved mitigation areas will be planted as required under the existing house Order of Conditions.
