Hi Kelly, As promised - below are what appear, in our view, to be the relevant sections from the regulations affecting the proposed dock at 122 Mayflower Terrace. The relevance of these regulations are that our “bulkhead (i.e. sea wall) and any part there of” still exists and has been present at least since 1969, as documented by photographs provided and also demonstrates long- standing use by us, and proximity to proposed dock. None of this information was included in the Carrus’ submission of nearest pier. Thank you again for your consideration of our concerns. With best regards, Lorna Pg 17, 19, 20 Approved at Public Meeting December 1st 2016, published December 12th, 2016 TOWN OF YARMOUTH WETLAND PROTECTION REGULATIONS 1.04 Definitions Pg 4 Docks & Piers shall be used interchangeably for the purpose of these regulations and shall mean the entire structure of any pier, dock, wharf, walkway, bulkhead, or float, and any part thereof, including pilings, ramps, walkways, float, tie-off pilings, dolphins and/or outhaul posts. (4) GeneralRequirements (a) Docks and Piers: (3) Piers shall not be constructed so as to interfere with any longstanding public recreational use of the waterway (5) The base of the pier shall be as close as possible to the center line of the lot, and it shall project outwards at an angle as nearly perpendicular to the shoreline as possible. 1 (12) New proposed docks, piers and floats (as defined in these regulations) shall not be allowed within: (a) Seventy-five (75) feet, of adjacent docks, piers and floats, with the exception marinas. (d) No new pier or float system shall be located closer at any point than twenty-five (25) feet to a property line, except, for a pier jointly owned and used by two (2) or more contiguous shorefront properties, or written permission from the abutters is obtained in order to minimize environmental impacts such as the need for dredging. The twenty-five (25) foot setback shall be measured from the outermost property lines of the applicable properties. 2
