Fowler 51 Abells Road West Yarmouth, MA 02673 Re: 51 Abells Road Accessory Apartment Status Dear Mr. & Ms. Fowler: On October 26, 1989 the Zoning Board of Appeals granted the former property owners, Bruce & Eleanor Gustowski a Special Permit to allow the construction and use of an Family Related Accessory Apartment,via Petition No.268. That Petition was granted pursuant to the provisions of Zoning Bylaw Section 407. Please be advised that Section 407.3.1, para. 3 provides that "the Special Permit for a family related accessory apartment shall terminate upon the sale of the property or transfer of title to the dwelling unless the new owner(s) files a new Declaration of Covenants at the Barnstable Registry of Deeds at the time of transfer or within 45 days of the sale". "If no action is taken ----then the new owner(s) must apply for re-approval of the Special Permit". In reviewing the Assessors' records I see that you took ownership of the property on September 12, 2018. Accordingly,you are required to take this action by submitting an application with the Board in order to retain the use of the Accessory Apartment.
