VIOLAITON NOTICE

Inspection Date: January 22,2020
During the course of inspecting the structure located at 20 Butler Ave., South Yarmouth,I observed the
following Building Code and Town of Yarmouth Zoning Violations:
780CMR,MA State Building Code Violations
First Floor
-No Smoke Detector outside the bedrooms.
-No operating Carbon Monoxide Detector.
-The clothes dryer, located in the kitchen is vented with a flex hose,penetrating a wall.
The concealed vent duct is required to be a metal duct.
Second Floor
-No operating Smoke Detectors outside the bedroom located off living room.
-No Smoke Detector outside the bedroom, located off the kitchen.
-The exterior deck stairs do not have a handrail.
-The exterior deck has an extension cord and a portable shop lamp"to illuminate
the stairs. Note: There is a switch operated light on the opposite side of the sliding
doors.
-Rooms were created without benefit of a Building, Plumbing, and Electrical Permits.
-The interior stairs are obstructed by over-hanging shelving,restricting the stairs to less
than the required 36 inch minimum width.
-The interior stairs do not have a handrail.
-The bottom stair riser is higher than the other risers(variable rise).
-No smoke detector at the bottom of these stairs.
-The light at the bottom of stairs is not operating and is hanging from the ceiling.
-The step at the bottom landing is less than 36 inches in width.
-The head room at the bottom of the interior stairs is less than the required 6 feet 6 inch,
minimum.

Basement:
-Rooms were created without benefit of Building, Plumbing and Electrical Permits.
-One room used for sleeping purposes lacks an emergency escape window/no window.
-Two rooms used for sleeping purposes lack compliant emergency escape windows.
They are more than 44 inches above finish floor and are less than 5.7 square feet. In
addition,they open inward.
-No smoke detectors outside the bedrooms.
-The interior stairs are obstructed by one-half the width, by storage shelving, placed
directly on the stair treads, reducing the clear width to less than the 36 inch, minimum.
-The exterior stairs do not have a handrail.
-The exterior stair system does not have a landing at the top of the stairs,at the level of
exit discharge.
-The room containing an oil fired boiler, lacks appropriate/sufficient make up air
(combustion air).
-The oil burner is leaking No. 2 oil at the filter and line connections, into open
pans. In addition, a larger bucket contains No. 2 oil. This bucket appears to be used for
depositing oil when the small pans are filled. This oil leak and over-flowing pans have
created absorbtion into the concrete floor surrounding the boiler. There is a strong
odor of oil in the adjoining area, which is being used for sleeping purposes;containing a
bunk bed.Yarmouth Fire Department was called immediately.
-Remove the double sided dead bolt located on the kitchen door.
-The interior stairs are not illuminated(no light).
-The electric clothes dryer, located in the bathroom,vents directly into the bathroom.
Narrative Summary
This inspection was conducted in coordination with the Yarmouth Health Department Housing Inspector, Kevin
Hook and his assistant Meredith Chaissen. Electrical Inspector Ken Elliott and Plumbing/Gas Inspector Lee
Hall were contacted and requested to investigate based on numerous related violations observed. They will
provide a written list of violations under their jurisdiction. The oil burner switch was turned off during our
inspection. The people occupying the basement were ordered to vacate that area, immediately,based on the oil
leak and the bedroom conditions, noted above. At the present time this single family structure is being used as a
multi-family dwelling. Fire Captain Kevin Huck and other Fire personnel, responded to the scene.

Building Code Enforcement Orders
Based on these observations and pursuant to the provisions of 780CMR, State Building Code,Chapter 1,
Section 114,you are hereby ordered to:
1. Cease allowing the occupancy of the basement,immediately.
2. Using the rooms in the basement level for sleeping purposes,is hereby prohibited.
3. Using the basement as a separate,independent dwelling unit is hereby prohibited,
4. Install interconnected hard-wired smoke detectors in all required areas,immediately.
5. Have a qualified person make the necessary repairs to the oil burner,immediately.
6. Remediate all other violations as noted,immediately.
Failure to do so will result in appropriate enforcement action,which will include the issuance
of Building Code Tickets with associated fines that range from$100 to$1,000 for each
violation,with each day constituting a separate violation,or the filing of a court complaint.
Zoning Bylaw Enforcement Orders
1. Cease allowing the use of the structure as a multi-family.Section 202.5,Use Al. Only single
family use is permitted.
2. Using the basement as a separate,independent dwelling unit,is hereby prohibited.
3. Using the second floor as a separate independent dwelling unit is hereby prohibited.
Failure to do so will result in the issuance of tickets with associated fines of up to$300 per
violation,per day,with each day constituting a separate violation.
