That's when I told them to remove the float and not put it back in, ever. The outhaul pile was never installed. Like you said, they tried to get the float initially, but apparently it was denied; that's why it is shown without on the approved plan an the license. So, there's no issue with the float in the driveway; it's been removed as part of the violation and shouldn't return. Mark Burgess Shorefront Consulting B.S. I went back to the meeting minutes and noted that the commission thought that a 6x16’ float was oversized for the use and conditions and the plan was revised to remove the float and include an outhaul piling instead. However, in 2010 a 16x6 float appeared in the aerials and is currently on their driveway. This is going to cause an issue in getting the COC for this one. Do you have the Ch91 license I can look at? I will make sure it's gone. Their son is staying there, and I'm sure he can handle it and take a picture of it. Otherwise, I'll do it myself. One way or the other, I'll get that to you ASAP with a picture. We can put a condition on the COC that bans further cutting, or we can handle it with the NOI, which I'll file as soon as I hear from Karl, or I can just start putting it together, along with the fresh water dock if you like and file it when I can. Good luck next week; my thoughts are with you. Mark Burgess Shorefront Consulting B.S. The trees removed due to tornado damage are OK but they should better document damage and notify me at the time. This area beyond the fence should not have any further cutting without prior approval. The area must be allowed to revegetate naturally. With the dock, there is an additional floating platform anchored to the landward end of the dock that should be removed as it is damaging the marsh. Please ask them to remove it before the hearing. It should not return. Thanks Kelly Grant Conservation Administrator Town of Yarmouth 508-398-2231 Ext 1288 kgrant@yarmouth.ma.us 3
