Re: 41 Standish Way, Affordable Accessory Apartment
Dear Mr. Dugal:
Pursuant to the provisions of Zoning Bylaw Section 407.4, Records & Inspections, this
department is in the process of reviewing the Accessory Apartment data base for required
inspections. During the course of performing this process we see you do not reside at 41
Standish Way, West Yarmouth, but reside at 823 E. Third Street, So. Boston.
Please be advised that Zoning Bylaw Section 407.2, Para. 9, provides that "the owners of the
principal structure shall occupy, as their "primary residence, either the principal dwelling unit
or the accessory apartment". This owner occupancy requirement is also a condition of the
Special Permit No. 4577, issued by the Zoning Board of Appeals and noted as condition No. 6.
Based on the fact that 41 Standish Way is not your primary residence, the Accessory Apartment
is not lawful and the use shall be abandoned.
Accordingly, you are hereby ordered to cease allowing the use of the Affordable Unit by May 1,
2020. The removal of the stove and its gas line or outlet and associated wiring would constitute
such an abandonment. However, you will also have to speak with Mary Waygan, Affordable
Housing Coordinator, concerning how the removal of the cooking facilities impacts the
affordable unit conditions and your tenant.
Finally, an inspection and approval of this remediation, is required by this department.
