Notice of the hearing has been given by sending notice thereof to the Petitioner and all those owners of property as required by law,and to the public by posting notice of the hearing and publishing in The Register,the hearing opened and held on the date stated above. The Petitioner is seeking a Special Permit under Zoning By-law §104.3.2 or in the alternative, a Variance from§203.5 to extend a portion of the front step into the front yard setback.The Petitioner 14s was represented by Chris Kenney of Kenney Builders. .2 Mr. Kenny stated that the front steps (4) as presently constructed, are made out of PVC (plastic) a materials and protrude approximately 3 feet into the front yard setback. Mr. Kenny told the Board 0 that he was unaware of a violation when he constructed the steps and believed they were exempt from the front setback requirement. Mr. Kenny further told the Board that if he had chosen to construct the steps out of masonry material (which most front steps are made from) that he wouldn't have needed relief because masonry materials are considered part of the landscape and not subject to setbacks whereas PVC is considered construction material and is subject to setback requirements. Mr. Kenny stated that it was the homeowner's preference to use PVC due to its comfort and aesthetics and that PVC is being used, and preferred, by other homeowners in the development as they remodel their homes.Mr.Kenny provided pictures to the Board which showed the impact to be minimal to the subject property as well as the surrounding homes. Darlene Richard,an abutter,spoke in support of the project.No one spoke in opposition. The Board felt that it was a reasonable request, would have minimal impact,and that it would not create any undue nuisance,hazard,or congestion to the neighborhood or surrounding Zoning District and that the PVC steps would be more in keeping with the character of the neighborhood as it transitions from traditional to more modem materials. A Motion was made by Mr. Martin to approve the Special Permit, seconded by Mr. Baron. The Motion carried unanimously. A Motion was made by Mr.Nickinello,as requested by the Petitioner,to withdraw the request for a Variance without prejudice. The Motion was seconded by Mr. Martin. The Motion carried unanimously. No permit shall issue until 20 days from the filing of this decision with the Town Clerk. This decision must be recorded at the Registry of Deeds and a copy forwarded to the Board of Appeals. Appeals from this decision shall be made pursuant to MGL c40A section 17 and must be filed within 20 days after filing of this notice/decision with the Town Clerk.
