The Yarmouth Old King’s Highway District office has received multiple inquiries regarding the white vinyl fence that was recently installed at the front of your property. Please note that vinyl fences are not allowed in the OKH District. As such, you are hereby informed that you are currently in violation of the OKH Act for the following reason(s): 1. Installation of a vinyl fence without approval from Yarmouth Old King’s Highway Committee for appropriateness and setting. To clear this violation, the Yarmouth OKH Committee requests that the vinyl fence be removed within 30 days of receipt of this notice. Enclosed are the OKH District fence requirements. To seek approval for a fence, please complete the appropriate application and return it to the Yarmouth OKH office for review. Applications can be found on the OKH Department page on the Town's website at: www.yarmouth.ma.us/375/Old-Kings-Highway- Historic-District. In addition to the vinyl fence, the OKH Committee has concerns and continues to receive complaints regarding the visibility of the pool fence. Your property is in the heart of the Historic District and is quite visible to all that travel to take in the sights of this beautiful stretch of scenic highway. Being that the fence is not fully shielded, the view of the pool area, activity and apparatus is quite conspicuous and takes away from the character, charm and esthetics of this area that the Committee is charged to protect. During your appearance before the Committee on June 10, 2019, you agreed to obscure the view of the fence from both 6A and Vesper Lane. At this time, while we do see landscaping has been done, it does not serve to adequately block the view of the pool fence. Therefore, we must request you take further action such as planting evergreens, spaced close enough and of adequate size to effectively shield the view of the fence from the public ways. Please note that failure to comply with the OKH Regional Historic District Act is subject to fines and penalties as allowed per Section 12 of the Act. We appreciate the efforts you have put forth to beautify your home and property and it is our sincere hope that you understand our position and act swiftly to remedy the above-mentioned concerns.
