We dealt with the property manager, Lauren. When I contacted her initially she said she was the correct person to deal
with. I met with her on site, and notified her of the meeting, which she attended and discussed the matter with the
Commission. The fence has never received permitting and was recently replaced and extended on one side, at which
point it was brought to our attention. If permitting had been sought when the fence was replaced, which is a
requirement under the wetland protection regulations, the Commission would have advised that a split rail fence was
more appropriate for this location. Solid privacy fences interfere with the natural movement of the beach sediment and
therefore impede the beach and dune’s ability to provide storm damage protection. Solid fences reflect wave energy
and exacerbate beach erosion and erosion of neighboring properties. They can also become storm debris during a storm
event.

Hi,
My name is Phil Beccia. I am the President of Yarmouth Village Condominium Association (YVCA). Today,
our Manager received an undated Violation Notice issued by you regarding our beach fence. As a condominium
association, we usually receive an advance written notice from the Town of any hearing involving our property.
We received no written notice that you were holding a hearing about our fence. A fence that has existed for
decades separating our private property from the public beach.

Suddenly, your Commission has decided that what has existed for decades must be removed without written
notice, opportunity to support our position or any explanation of the Town's rationale in deciding to change
decades of past practice. Furthermore, your Notice provides no appeal process.
Clearly, you can see my concern and that of all our owners. We do not understand why at this time of Covid-19
the Town has decided that our decades old fencing must be torn down. Is there no recourse?
