HomeMy WebLinkAboutCorrespondence 7.1.2020 Grant, Kelly From:Grant, Kelly Sent:Wednesday, July 1, 2020 12:03 PM To:'Craig Meador' Subject:RE: 1 Shore Road Beach/Englewood Beach Condo Hi Craig Whenever work is proposed on a property within jurisdiction of the wetland protection regulations (state and local) an application is made to the Conservation Commission to carry out that work. Once the work is completed a Certificate of Compliance is required to “close out” the project and confirm the work was carried out per the approved plan and the conditions of the permit. There are three open orders that have never been closed out by the association. These are for: SE83-63 - Reconstruction of a seawall SE83-1133 - To place fill in area landward of the seawall SE83-1449 - To repair an existing seawall, add fill and construct removable wooden stairway This information came to light because a violation was reported at the property for the unpermitted removal of vegetation. On reviewing the file the open orders were found. Here is a link to information on the regulations. If you click on the link to Filing Forms, there is information on Requesting a Certificate of Compliance. http://www.yarmouth.ma.us/1222/Wetland-Protection-Regulations-Other-Inf I will see you tomorrow at 10am. We can discuss the matter further then. I have gone through all of the files that the link brought me to. I am not sure as to what the issue(s) are and would like a brief run down by you in order to share with the board of managers. In the documents, I see Rico Poliseno's name who passed away in 2008. The documents go back as far as 1976?? The next person's name that appears is Sid Massaro. He was legally removed from our board of mangers in 2018 for misconduct and immediately sold his condo at Englewood. Lastly, we are not planning any work or manipulation to the beach property. We also pay our taxes on the property on time. All of this adds up to confusion on my part. Do you have some time to phone me? I have included our Board of Managers in copy. We would like to get this matter resolved immediately. In doing so, we would like to request a site visit on Thursday, July 2nd in order to determine whether a violation has occurred. You can select the time. Will you be able to accommodate our request? Also, when we meet, would you be able to explain the three Orders of Condition that are mentioned in your letter? Again, we would like this matter resolved with immediacy. I would welcome your phone call to discuss this prior to Thursday. You can reach me on my mobile at any time.
