Hi Ariel
I have attached a document with two clipped maps from the Town GIS mapping. The first shows the mapped vegetated
area and the second shows the same map without the vegetation - so you can clearly see the property lines. The
eastern property line is 100 feet long - for scale. You can use this to file a Request for Determination of Applicability for
your proposed vegetation management. The forms etc. can be found here : http://www.yarmouth.ma.us/696/Filing-

With regard to the open Orders. When a project is completed or the Order is expired, the property owner needs to file
for a Certificate of Compliance. If the work did not take place, then a certified professional can attest to that as part of
the request. The reason these have come up now is that whenever there is activity at a property (in this case the
violation), a review of the file is done to see if there are any outstanding issues. It is a condition of the Order that it be
closed out with a Certificate of Compliance. An expired Order cannot be renewed so if you would like to do work at the
property in the future then a new Notice of Intent would be required.

Dear Ms. Grant:
I am Ariel Reyes and I am on the Board of Managers at the Englewood Beach Condos. You met with us last week with
regard to the above captioned matter. I was the last to arrive, so i apologize for my tardiness.

The attached diagram of the beach Lot-C1 shows the existing vegetation as well as the proposed extension of new
vegetation. The existing vegetation runs along Shore Rd from the gate, at which point the vegetation extends from the
fence about two feet and gradually increases, in width, to approximately five feet (at the corner of the fence), then
gradually decreases back to two feet as it runs along the fence line next to the public beach, toward the water. The
Association proposes to stake off an area of two feet (in addition to the existing two feet) on both ends and have them
gradually meet the existing five feet of vegetation. (See the diagram below).
With regard to the three Orders of Condition; it seems odd that these items dated 1976, 1991 and 1998 have now
become an issue. None of the work that was proposed on those documents has been done. We would appreciate more
guidance on this. Is it just a call to the Architect to ask him to provide proof that the work was not done? Is it filling an
extension so that, in the future, the work can be done if needed?
To that end, kindly let us know if the proposed diagram of our agreement to stake off the area will suffice, or if more
detail is required, as well as your advice on the Order of Condition.
