Thanks for your email. I think the main concern is with how the grading differs from the approved plan. There are areas
of significant slope that were designed to be contained behind retaining walls. I have attached the approved plan and
the as-built plan for your reference. The increased slope and grading to the property line does not allow for the same
level of infiltration. I understand that there is also a high groundwater issue in this location and that the flooding issues
will not be entirely related to run off from your property. However, the work carried out differs from that on the
approved plan, and the Order of Conditions required that any plan changes be reviewed by the Commission prior to
implementation. I suggest that you have a drainage engineer look at options for containing runoff onsite and bring a
proposal to the Commission for addressing the highlighted issues. This may include vegetating sloped surfaces to slow
runoff and increase infiltration, installing vegetated swales along the property boundaries or installing the proposed
retaining walls to reduce the slope.

Dear Ms. Grant, I am writing to you in connection with a Request for Certificate of Compliance which was
reviewed at your July 2 Meeting and resulted in a non-approval. I had engaged Down Cape to do the
appropriate surveying and file the Application. They suggested that I contact you to get a better understanding
of what concerns you the most of the items cited. Obviously I want to get this matter resolved as soon as
possible and if there are solutions to your concerns I would like to hear them
Please be advised that when my home was built in 2007/2008 I hired Eagle Engineering to do the appropriate
survey work mostly associated with the septic system and Phil Cheney to do the landscape architecture. The

grading and retaining wall work was done by MacNamara Bros. MacNamara followed the site plan done by Mr.
Cheney. I am not sure if the drawings done by Mr. Cheney are in your files .The foundation had to go to the
10foot high water mark and indeed created challenges which required the installation of several retaining walls
Much effort went into assuring that the house and landscaping was done with high quality and with a focus on
minimizing run off. I have now lived in this house for almost 13 years and have found that the gravel beds have
been satisfactory in capturing the roof run off and there has been no apparent runoff from the back patio which
does not have a gravel bed but is bordered by a planting of grasses.
Gutters and downspouts were not installed because the Great Island Association Guidelines prohibited them. At
that time the gravel beds were considered an acceptable option . They have worked well.
Lastly an 8x10 garden shed was put in after we moved in which I had been told did not require approval
because of its small size. The patio and back stairs were recommended by Mr Cheney because of elevation
issues in the back of the house. This is a small patio large enough for a single table and chairs with two steps up
to a small landing which leads to a back sliding door . It is conceivable that the plan by Eagle showed a patio in
a totally different area. Frankly I don’t remember.
I am well aware of the flooding issue in front of my house and other houses in the immediate area. This has
been a problem since the original house was first purchased in 2001 and goes back to the 70’s when I first
rented at what was then called Radio City. I am told the Association is trying to come up with solutions to this
problem but I can assure you it existed before this house was built on the property. While there may be some
runoff from rain that falls on the grass, I do not think it is significant. Almost all of the rainwater from the roof
is captured and does not run off.
