I was able to actually meet with Mr. Rosales today.
I measured the water at the stake, and it's 2.1 feet today.
I tried to explain that if the water level is 2 feet or higher as an average, then if it's low in August, that's not the
average.
And I explained how I determined the water level, as explained in the narrative.
He has a full copy of the NOI and the plan.
I also sent him some pictures and plans (59 Lakeland) that show that the dock only has to be 120 square feet
below the normal water line, not 120 square feet total.
The definition for the entire dock in the definitions is interpreted for salt water docks, to include the ramp and
float for the 80 feet from MHW.
I explained that the fresh water regs came later, so there is a discrepancy in the interpretation.
After some discussion, he just doesn't want to see the dock so much.
He would like me to move it to the other side of the path; perhaps angle it a little bit north.
The centerline of the dock is currently 24.7 feet from his property, and 20.6 feet from the north line.
I would need a variance (due to lot configuration) to move the dock over, but he would be agreeable.
Otherwise I think he would appeal.
He'll be on the meeting and we can discuss further; I tried to get as much of a resolution before the meeting.
