I appreciate your taking the time to meet us at the Harris residence on July 15, 2020 to review your concerns relative to
compliance with the above Orders of Conditions.
We are offering the following as a resolution to your concerns:
DEP File No. 83-1680
You expressed a concern that the driveway that was constructed with pervious pavers was not allowing enough
infiltration of stormwater runoff and therefore was not in substantial compliance with Condition 9 in the Order which
stated “The driveway shall be constructed of pervious materials such as crushed stone, gravel, seashells, or other similar
materials.” The plan approved under the Order indicated driveway pavers but there was no detail providing
construction specifications for the pavers. You indicated that the Commission has allowed pervious pavers for driveway
construction for other projects in the recent past.
As a resolution to this issue, we are proposing that the last row of pavers before the granite transition block at the end
of the driveway, a line of 8 inch pavers laid parallel to each other, be removed and replaced with a 12 inch deep layer of
¾ inch angular crushed stone. This would serve to capture the runoff from the driveway prior to discharge to Flakeyard
Lane or the abutting property.

You expressed a concern that the plantings specified to be replanted after the reconstruction of the revetment per the
plan approved under this Order were not present on the property. As a resolution to this issue we are proposing to
replant these shrubs in accordance with the attached Revised Planting List as discussed at our site meeting. You
indicated that you would prefer that we not replant the 7 Rugosa Rose and that we could request to substitute Beach
Plum for them. The Revised Planting List reflects this request. The plantings would meet the requirements of the Cape
Cod Cooperative Extension (attached).
I would appreciate your reviewing this at your convenience and confirming that you are in support of the above
resolutions and could recommend to that the Commission that they issue the Certificates of Compliance for these
Orders of Conditions.
