There were two aspects rolled into one application; first there was extensive landscape work including white fencing and shrubbery, and second, painting of doors, shutters and the brick foundation. There were 3 letters in opposition to the project received before the meeting from abutters and concerned citizens. Those parties also spoke at the public meeting. All were in favor of denial and/or postponement for more homework to be completed and the need for an accurate land survey to be done. Questions concerned with sidewalk and curbing also needed to be clarified. A picture of a fence with bushes in Nantucket was shown but there was no definition of what was being proposed. The heights, etc. were also in a state of flux. It was noted that the front yards of various homes and businesses on the south side of Rt 6A were similar to one another and quite different from those on the north side. The proposed design was not in keeping with the streetscape of that section of Yarmouth Port. Consideration of the paint project established agreement to applying black paint to the doors and shutters. The committee did not consider it appropriate to paint the brick foundation black but suggested that a clear sealant be used instead. It was suggested that the paint project be applied for using a Certificate of Exemption which would not need consideration of the full committee and could be done quickly to keep that part of the project on track while the weather is good. Otherwise delete this email. All: Good afternoon.I am the owner of 7 Minden Lane,Parcel No.122.118. I am also a former Planning Board member. I am writing in strong opposition to the proposed fencing and hedges in the front of the property at 174 Route 6A, Yarmouth Port,MA("Happy Fish"or the"Premises"). I reserve all comments as to the remainder of the submitted plans. Importantly,the proposed fence and hedges to be placed at the front of the Premises will significantly limit the ability for drivers coming down Minden Lane to see oncoming traffic.This includes all the patients and clients at Briarpatch Pediatrics and JJ Mannings,USPSand FedEx drivers,and guests and residents of Minden Lane. Under no circumstance can the Town,in any manner,permit(a)parking in the front of the Premises along 6A;(b)any further obstruction of line of sight for oncoming traffic;or(c)permanent elimination of the sidewalk. Any approval of same will be met with an immediate appeal. The inability to see oncoming traffic,moving west to east has been presented to the Applicants on numerous occasions. Most recently,on July 27,2020,I wrote to the owners,discussing such concerns,most significantly as to parking vehicles in front of the Premises.I've attached that letter for your review. Despite clear warning that such parking is not an appropriate use of the space,and a hazard,they did nothing to stop same.Such parking continues to take place to this day. Notably,their plan submitted before the Committee does not include replacement of the sidewalk they dug up. That is,of course,because they don't intend to replace the sidewalk for pedestrian use,but instead,intend to utilize same for their own parking. I have confirmed with the Town that they are not permitted to do so,and moreover,the applicable regulations require that they do not do so.Despite the clarity of this,they continue to have their guests park upon the sidewalk on a daily basis.It is,quite frankly,absurd,that the Town continues to permit this to occur. It is extremely challenging to see oncoming traffic now,while the Applicants flaunt their repeated violations;it will be impossible if they are permitted to further decrease visibility with their proposed fence and plantings.While I understand that the parking concerns may not be the purview of the Committee,the overall impact that the proposed plans will have with inappropriate use of land for parking must be considered. It is not appropriate for the Committee to approve(a)the destruction of a pedestrian walkway;or(b)an increase of a dangerous hazard. The Applicants have presented no hardship for the fence or plantings,that have no historical significance for that Premises.Merely,they want it.That is not an appropriate reason for the Committee to approve of it. The purpose of the Old King's Highway Regional Historic District Act is"to promote the general welfare of the inhabitants...through the development...of appropriate settings and the exterior appearance of such buildings...." Permitting the creation of a fence and plantings,that have never been alleged to have been historically present at that location,which creates dangerous conditions,is antithetical to the general welfare of Yarmouth residents.The Committee is charged with determining"whether such application may be approved without substantial 1 detriment to the public welfare." There is no possible approval of a fence and hedging in this location that does result in a substantial detriment to the public.You will unequivocally be endangering residents. Perhaps most troubling is the fact that the Applicants failed to even mention to me their plans to build further visual obstructions with the fence and plantings.I've had several communications with the Applicants since their application, and at no point in time have they mentioned it. It is galling that they would attempt to slide this through the Committee,while simultaneously having discussions with a neighbor about safety and not mention it.The clear motive of the Applicants is to obtain parking out front of their building—safety and accessibility of the public be damned. The Town should not permit this to occur. It is requested that(a)the Town issue an enforcement order,prohibiting parking in the front of the Premises;and(b) the Old King's Highway Committee deny the application as it relates to any addition of fencing/planting in the front of the Premises. Parked cars are often well over the line into the road.All of this creates a hazard and a disaster waiting to happen. I am the single property owner that would be impacted by your use of your parking lot,rather than improperly having people park on the sidewalk. Good Afternoon, Good Afternoon, I and my partner Gary Blondin are the abutters to the above-mentioned property. We would like to voice our objections to the 4ft high evergreen shrubs being placed by the Burbanks on the east side of the above-mentioned property. At this time, as owners’of 175 Main Street) do object, as the property line is in dispute and we are having it surveyed. The proposed evergreen hedge on that side would be so close to the property line that it disrupts any exit from our second floor unit’s secondary exit staircase which exits to the outside and side of the property. It will also block any emergency access to that unit via the staircase for tenant purposes or emergency personnel in the event of an emergency. Furthermore, as our buildings are non-conforming, preexisting in their set back from the lot lines, hedges so close (within less than 2 feet) to the lot line and our building create a moisture and shade condition causing damage to the side of our building; and an impossible access and hindrance to maintenance of our building. This could cause potential damage and concerns for insurance purposes. Please see attached photos of the property where it abuts ours. There has already been severe disturbance to that property line without any notice or lot line determination and we are in the process of having the lot line clarified. We have contacted a surveyor and are awaiting his completion of the job at this time and expect it to be finished in the very near future. No matter the determination of the exact line, the close proximity to our building of the hedges planned would be detrimental to our property and interests. We urge you to decline the approval of the hedges proposed by the Burbanks on the adjoining edge of the property.
