I thought that I submitted this NOI to DMF when I filed the application with the Yarmouth Conservation Commission, but I
cannot find a record of having done so. The Commission held one hearing on July 16 with a continuance on August 6,
2020, awaiting a DEP file number and DMF comments.
The subject pier is fully licensed and the structure, as it currently exists, conforms strictly with the License Plan. The
Applicant is proposing modification of the pier in response to the Conservation Administrator's concern about the existing
floats grounding out on the salt marsh. As discussed with Kelly Grant, 3 of the landward floats are to be removed and
replaced with an extension of the fixed walkway section and a ramp to access the 2 remaining floats.
Dave Hill has indicated that this work can be done within the pier's existing footprint with a minor plan modification that will
not invalidate the existing 99-year Amnesty License. The Yarmouth Conservation Commission approved the
maintenance and repair of the structure in 1978.
There are no other changes proposed. The Applicant only is willing to incur the expense of the pier modification to
mitigate for existing environmental impacts in as far as the work does not invalidate his existing License.
