Provided there will be no installation or work within symbolic fencing and all work is performed by hand/hand held tools then Division is comfortable with this installation to occur on 8/15 without the oversight of a shorebird monitor. As you are in agreement with this Aug 15 install date, we do not need you to reissue your attached letter. Your efforts to be sensitive and accommodating to state-listed species are much appreciated and it is good to hear that there are groups that appreciate and respect our natural environment. Raking by machine or hand, when done conscientiously, can be compatible with state-listed species. Seagull Beach is a site that typically has good nesting and fledgling success. While I’m not personally familiar with this site, it appears to be well monitored and it likely has adequate symbolic fencing to protect nests and unfledged chicks. My note was not to rush you, just wanted to make sure you have our request. I 2 Appreciate all your help, as always. We only had one raking this summer due the covid impacting the rakers scheduling. Audubon was there, we have a very good relationship with the shorebird monitor, and they were happy with our raking. We continue to be environmentally sensitive to our beach & dunes. We see that the Town beach next to us(Seagull Beach) is raked a few times a week with a large raking machine pulled by a tractor, our raking machine is only 34” wide, and a screed smooths the tire tracks.
