Yarmouth, MA. This release was issued Release Tracking Number (RTN) 4-28368. This package has been prepared by Jewel Environmental Corp. (Jewel) on behalf of the potentially responsible party (PRP) Allied Waste Services, Inc. (Allied) to finalize the site’s compliance with the Massachusetts Contingency Plan (MCP), 310 CMR 40.0000. This PS report, associated transmittal form (BWSC-104) and Release Notification Form (BWSC-103) was submitted via e-DEP. Refer to Figure 1, the Site Locus, for the regional location of the site. Information required for a PS, as specified in Section 310 CMR 40.1056 are contained in this document as a whole. This PS report package applies only to the July 2, 2020, sudden “2-Hour” reportable release of hydraulic oil. Additionally, this report only applies to the disposal site as described in Section “I. Disposal Site and Activity and Use” of this report, and as referenced in Figure 2. 2.0 RELEASE HISTORY According to information obtained from MADEPs release logs and discussion with personnel from Allied and Emergency Response and Training Solutions (ERTS) in Solon, OH, the following sequence of events lead to a release of an estimated 60 gallons of hydraulic oil. On the morning of July 2, 2020, at approximately 7:00 AM an Allied Truck ruptured a hydraulic line while in the facilities parking lot. Following the release emergency responders were notified as was Allied operations. Allied notified ERTS who at 8:23 AM reported the release conditions to the MADEP. The MADEP determined that based on the volume of the release it may be a disposal site, as defined in the Massachusetts Contingency Plan (MCP), 310 CMR 40.0000. The MADEP also had reason to believe that Allied was or may have been a PRP, based on their status as generator. As such a Notice of Responsibility (NOR) was issued to Allied and a copy is included in Appendix A. According to the 310 CMR 40.0000 general response action requirements include the need for conducting an Immediate Response Action (IRA), the need for hiring a spill cleanup contractor, the need for employing or engaging a licensed site professional (LSP) to manage, supervise, or actually perform necessary response actions. Specific approval was given to use absorbents to contain and remediate the release. 3.0 IMMEDIATE RESPONSE ACTIONS Refer to Figure 2, Site Plan, for the disposal site boundary and pertinent site features; Appendix B, for waste disposal documentation, and Appendix C for Public/Owner Notification Letters. On July 2, 2020, immediately following the release, Allied personnel placed speedi-dry over the release area. On this same day Moran Environmental (Moran) of Randolph, MA, visited the site to conduct remedial actions. Moran picked up the previously placed speedi-dry and placed it into 55-gallon Department of Transportation (DOT) approved metal drums. Moran then placed additional speedi-dry over the heavily impacted areas and worked the speedi-dry in to remove remaining oil and staining. The speedi-dry was then picked up and also placed into 55-gallon DOT approved drums. A total of four drums were transported under uniform hazardous waste manifest to Red Technologies in Portland, CT, for proper disposal. JEWEL ENVIRONMENTAL CORP. © 2020 PROJECT No. 716 2 Also on this day a Jewel representative inspected the impacted asphalt surface(s). The asphalt areas were in good condition with no obvious signs of cracks or holes that would allow migration to subsurface media. No impacts were observed in any catch basins or soil areas. 4.0 DISPOSAL SITE & SITE ACTIVITY AND USE The site starts in the parking lot of 61 Commonwealth Avenue in S. Yarmouth, MA. The disposal site specifically relates to an area of asphalt parking lot surface measuring approximately 60’ long by 12’ wide at the widest point. The disposal site is located on a parking lot in a commercial area and future site use is anticipated to remain the same. The property where the site is located is identified on the Yarmouth USGS Quadrangle (via Mass GIS on-line) at Universal Transverse Mercator (UTM) coordinates 399691 Easting and 4615767 Northing (Figure 1). Based on the Mass GIS Numerical Ranking System Map (Figure 3), no portion of the site is located within an area of estimated rare wetland wildlife habitat or a protected open space and no named water bodies are located within 500’ of the disposal site. 5.0 CONTAMINANTS OF CONCERN The reported release at the disposal site relates to Hydraulic oil. In accordance with MADEP Publication #WSC-401-91, the most recent version of the MCP, and the “Implementation of MADEP VPH/EPH Approach”, to properly evaluate such a release, it is recommended that the assessment activities evaluate the impacted media for residual concentrations of Extractable Petroleum Hydrocarbons (EPH) and target polynuclear aromatic hydrocarbons. Soil: Based on the condition of the asphalt surface(s), inspection of the areas, and on the minimal volume of the release, soil was not impacted by this release; therefore, contaminants of concern do not exist with regard to soil. Groundwater: Based on the condition of the asphalt, groundwater was also not impacted by this release; therefore, contaminants of concern do not exist with regard to groundwater. Asphalt Surface: Based on remedial efforts following the release, Jewels inspection of the asphalt surface(s), and on the minimal volume of the release over a large area, contaminants of concern no longer exist with regard to asphalt. 6.0 SOIL & GROUNDWATER CHARACTERIZATION Pursuant to 310 CMR 40.901(3) and 40.931, as the release has been reduced to a background condition a risk characterization and determination of category standards are not required. 7.0 EXPOSURE POINT CONCENTRATIONS & CRITICAL EXPOSURE PATHWAYS Pursuant to Section 310 CMR 40.0925, an evaluation of the contaminant conditions was conducted to define potential exposure point pathways and critical exposure pathways. Exposure point pathways are defined, without limitation, as ingestion, inhalation, and/or dermal absorption of impacted media. Critical exposure pathways are defined as those routes by which oil and/or hazardous material(s) released at the disposal site are transported, or are likely to be transported, to human receptors via vapor phase emissions into a living or work space of a pre-school, daycare, school, or occupied residential dwelling; or ingestion, dermal absorption or inhalation of measurable concentrations of oil JEWEL ENVIRONMENTAL CORP. © 2020 PROJECT No. 716 3 and/or hazardous materials from drinking water supply wells located at and servicing a pre-school, daycare, school, or occupied residential dwelling. Based on the site conditions, the contaminants of concern have been reduced to background. Thus, based on the current and future nature of the defined disposal site, potential routes of exposure do not exist at the site. It is Jewels opinion that CEPs do not currently exist with respect to the disposal site conditions. 8.0 CONCLUSIONS Pursuant to 310 CMR 40.1040(1)(a-f) and in the opinion of Jewel, a PS with No Conditions applies to the Disposal Site because: “A level of No Significant Risk exists; the source of oil and/or hazardous material (OHM) has been eliminated or controlled; there is no groundwater plume or groundwater impacts; there is not vapor- phase impacts in the vadose zone; there is no separate phase product; all threats of a release have been eliminated; and, the level of OHM in the environment is consistent with background to the extent feasible.” It is Jewels opinion that a PS has been achieved and no further action is required at the defined disposal site with respect to this release. A copy of public notification letters to the Town of S. Yarmouth Chief Municipal Officer(s) and Board(s) of Health and/or property owner(s) as required pursuant to 310 CMR 1403 are provided in Appendix C.
