Hi again, here is a link to the executive order. https://www.mass.gov/doc/covid-19-order-42/download See 3. Tolling
period.
Your Order will not expire until after the state of emergency has lifted. By my count your Order will expire 188 days after
the state of emergency is lifted by the Governor. We can confirm once we reach the end of the state of emergency or
you can file a request for extension now. That is up to you. A request for extension should be submitted in writing with
a $75 fee.
Please note that your property is still on the agenda for tomorrow due to the float violation.
Regards

Hi A.J. & Tina,
Actually – your email reminded me that there may be a permit extension allowance under the Governors
declaration. Let me look into it and get back to you.

Dear Ms. Grant,
Thank you for the Meeting Notice for the Yarmouth Conservation Committee on
09/17/2020. It was never our intent on being late to request an extension of Order of Conditions for 40
Crosby St. Ext. A.J. & I both thought the expiration was in 2021. Since Governor Baker's declaration
of State of Emergency on March 10th 2020 and then on March 23rd 2020 designating our business
as essential, we have been working 7 days a week.
That has left little time for any ongoing projects(outside of business) to be supervised by us. We
would be requesting a 3 year extension to complete our Order of Conditions.
To date, work related Orders of Conditions that we have completed are #7, #8, #9, #10, #11, #12,
were all diligently monitored during the building of our home, #13 trench drain per condition
completed, # 14 existing septic system removed was completed before delivery of home to the site,
#15 gutters/downspouts directed into adequately sized drywalls completed, # 16 grading, # 20
landscape debris continuously cleaned up and not allowed within wetland resource area, # 21 the
unpermitted dock on a mushroom was immediately removed after original hearing. During the
meeting there was a request to remove hardscape in lieu of some mitigation.
They were immediately removed during the razing of the old house, the hardscape/cement shelter on
the beach/embankment, the statue of Mary and the surrounding brick enclosure and the statue of St.
Francis and surrounding brick enclosure. An erosion blanket has been in place where the hardscape
from the beach embankment had been removed. Stablization of that area will be completed this fall.
We would like to address the 35 foot buffer from the coastal bank and meadow area after our
daughters wedding on September 4, 2021 which will be held at Crosby St. We would like to be able to
concentrate and provide for her needs on her special day. Thank you for your consideration on the
extension and again we apologize for the timing, it was not our intention to forget.
Sincerely,
A.J. & Tina Luke
