Hi Mary
If you are working with 100 feet of a wetland you need to file with the Commission for approval. The RDA is a
simplified process for small scale projects like yours. Once I have a complete application I will add it to the
next available agenda.
Thanks

Hi Kelly...
Yes, I am aware of the filing fees; however, since we are outside of the wetland zone, I do
notunderstand the reason to continue the process. In fact, at this point, we will be even farther
away from the wetland than the survey indicates. Additionally, the OKH approved a new
driveway entrance of the driveway when we met with them in 2016 or 2017 regarding the shed
and house addition. The current driveway intersection with the street is not safe for several
reasons: 1. its intersection with Dartmoor, 2: very limited visibility to the east at street
intersection, 3. impact of snow removal from Dartmoor, blocking the driveway.

Hi Mary
I received your Request for Determination of Applicability. Unfortunately the application is
incomplete. At the link provided http://www.yarmouth.ma.us/696/Filing-Forms you will find a
checklist of the items to be provided. FYI - the filing fee is $75 and the legal ad fee is $10.
I can give you an extension until 3pm today (the deadline is at noon) to provide a complete
application to get on the Oct 1 agenda.

Thanks Mary
If you are working within the 100 foot buffer then you will need to file with the Conservation
Commission for approval. If the work is limited to the driveway, the driveway is made of
pervious material, and is outside the 35 foot no-disturb zone, then a Request for Determination
of Applicability may be sufficient.
The filing forms and instructions can be found here http://www.yarmouth.ma.us/696/Filing-
Forms (scroll down to the Request for Determination of Applicability documents)

Hi Kelly,
I have the recently completed property survey by Ron Cadillac which shows the wetland as
determined by Hugh Hall and the proposed driveway which does not touch the 35’ setback from
the wetland points. Obviously, the driveway has been moved to comply with the setback. In
2
addition, we may, at this point, simply, follow the footprint of the existing driveway.
Considering the above, do we have any other requirements?
Thank you,
Mary Preikszas
