I just noted there is already an Order of Conditions on file for this property. The Order will need to be closed out before
a new Order can be issued. If the work never took place this will be a relatively simple process. Here is a link to the file

I can’t speak to the building permit process but in terms of the wetland protection regulations you could file a Notice of
Intent with a site plan that shows the proposed footprint, any proposed regrading, extent of clearing, location of septic,
driveway etc. You could then get detailed building plan done at a later date. In addition to the above the commission
will want to see a note that gutters and downspouts will be directed to drywells and you will need to demonstrate that
the proposed work will not have a negative impact on wetland resource areas – particularly by diverting, deflecting or
channelizing storm flood waters.
If approved, the Commission would issue an Order of Conditions for the project which is recorded with the deed and
transfers with ownership of the property. If you needed to make minor changes in the future you could come back for a
plan revision or an amended order of conditions.

Good afternoon,
I am a real estate agent representing a seller of a lot at 194 Pawkannawkut Drive, South Yarmouth.
The owner would like to do some of the preliminary work of getting a building permit to make it easier to sell
her lot.
I have been talking to the building department as well. They suggested I talk to conservation to find out what
they would require to get a building permit.
Can we get the lot approved without a building plan? For example, could the lot be approved for say a house up
to 3000 square feet that meets the required set backs? Then the buyer would just have to get their house plans
approved.
What would the steps be to get a building permit?
