In terms of our permitting process, the dock itself predates the regulations so its existence is not an issue, however we need an approved plan for the dock – usually the license plan serves this purpose until such time changes are made to the dock and the permit plan is required. The best way to move forward is to file for a Ch91 license with the state and the Commission can provide a letter stating they acknowledge its existence and have no issue with the application. I suggest you have a survey plan put together for the license that you can then bring to ConComm for review and approval. An RDA may be sufficient for this. Have there been any changes to the dock or flat configuration over the years? It seems to me that something is not quite right as I am not sure how a dock of this size could not only be installed however operate without the proper Permit for a number of years. The Blue Rock Heights Association and I have always tried to do the right thing. Since I asked you to meet with me I have spent multiple hours researching possible reasons as to why you have no Permit on file. Please keep in mind I asked for you to come in and tell us what we could or could not do. In addition, I have gone out of my way on a number of occasions to again do the right thing. As an example is my reporting to you on 3/29/18 of a neighbor dumping in Bass River is one such occasion. In addition I have been told by Representatives at the Waterways DEP that they are not a hard fisted organization. Meaning they do not force their authority on any organization or individual in respects to Permiting. It should be noted with all transparency that could change anytime with changes in Managing ideals. It was also mentioned during that conversation that the Town of Yarmouth has the ability to grant amnesty to a situation such as ours here in Blue Rock Heights Association. 1 Kelly, what it comes down to is we at Blue Rock Heights Association have always tried to do the right thing. As mentioned previously, I have been responsible for the Marina here in Blue Rock Heights for 8 years. In all that time I can tell you for certainty that my judgement has always been done with the best intentions for all concerned. That would not only include Blue Rock Heights Association, however the Bass River and the Town of Yarmouth. Based on all the above information I am asking could Blue Rock Heights Association be Grandfathered in and allowed to continue to operate our Marina as we have for the last 50 years. If so would we have your support and how would we begin the process? Thank you for your assistance in this matter. Robert J. He has been adding to it for a while now. At one point 8 years ago or so, he was caught dumping in our Marina parking lot. I still think he does in the off season when no one is around. You should see how much I pull out each year. I am willing to bet he doesn't even have a dump sticker.
