I certify that I understand the following requirements regarding any changes that may
be required for this project:
In accordance with paragraph 2(a) of section 1.03(General Procedures) of the OKH 972
CMR Rules and Regulations: Only minor changes may be approved by the Committee
without the filing of a new application and a new hearing. Minor changes include
alterations that can be done without a detrimental impact on the overall appearance of
the project such as altering a single window or door change or a minor change of
colors. All minor changes by amendment will require the local Committee's or its
designee's approval.
All changes to previously OKH approved plans require notification to and approval
from the local OKH Committee. Change requests must be submitted to the Committee
in writing on the appropriate request form, which may be obtained from the OKH office.
All change approvals must be obtained before incorporating the change into the
project.
If the change has been implemented prior to receipt of OKH approval, a Minor Change
approval or Certificate of Appropriateness application for the revised plans is still
required and will result in a doubled filing fee for the appropriate category of work.
Failure to comply with the above statements will result in the Building Department
issuing a stop-work order or delaying issuance of an Occupancy Permit or final
inspection approval.

Dear Sirs/ Madams:
Please be advised that this office represents the interests of John C. Stuart and Barbara
Barron-Stuart, owners of the premises located at 182 Hallet Street (Route 6A) in Yarmouthport
and direct abutters to the premises owned by Krishna Sprinkle located at 180 Hallet Street
(Route 6A) in Yarmouthport, both properties being located within the Old King's Highway
Historic District Commission. Please let this letter serve as a formal opposition of my clients to
the above-referenced Application for Appropriateness regarding a non-conforming 8 foot high
fence, 72 feet in length proposed by Ms.Sprinkle. In the application filed by Ms. Sprinke, the
Description of Proposed Work reads as follows:
72ft of 8ft fence wood. Natural buffer was cut and there is a commercial parking lot
with car headlights shining into my house (emphasis supplied)
The fact of the matter is that the natural buffer of foliage and shrubs was cut down by Ms.
Sprinkle herself and now she claims that this necessitates construction of an 8 foot high fence
that is both non-conforming in height and also in violation of the Old King's Highway Historic
District Committee" mission. It is our contention that Ms. Sprinkle's desire to erect the
proposed structure, at least in part, emanates from animus that she has for my clients in
violation of G.L. c.49, Section 21 and if allowed, would constitute a private nuisance as defined
therein. (see copy of statute attached).
As an example of Ms. Sprinkle's animus towards the Stuarts, she maliciously cut down a rosa
rugosa and shaved off the front portion of a 50 year old flowering quince that Barbara Stuart
had been gardening and tending to for approximately 35 years.These plants were on a small
wedge of property that was cut out of the front yard of the property belonging to 182 Hallet
Street to create the required 50 feet of frontage needed by the developer to sub-divided the

property into two lots thereby creating the land associated with 180 Hallet Street. These
plantings were much admired by the neighbors over the years and there can be no reasonable
or rational reason for Ms. Sprinkle's destruction of them other than to annoy Barbara Stuart.
Similarly, Ms. Sprinkle has used vulgarities directed at Barbara Stuart and reacted with vitriol
directed at John Stuart when he was simply cutting up a fallen tree on his own property after a
storm.The downed tree was blocking the rear entrance to the Stuarts' shed. It was shortly after
this, that Ms. Sprinkle began planning to erect the proposed fence. Indeed, Ms. Sprinkle now
verbally accosts the Stuarts virtually every time they are in their backyard.
In closing, the historic nature of the Stuart's home should be of paramount importance to this
Commission. It was built in 1690, is listed on National Historic Register and has been
painstakingly restored by the Stuarts. It is the most photographed and painted house in the
Town of Yarmouth and is referred to by artists as "Motif Number 1" in Yarmouthport. If
allowed,the proposed modern fence would not only be virtually in my clients' back yard, but it
would also be visible from Route 6A and would detract from the historic nature of the vicinity.
We urge the Commission to deny Application Number 19-A089 and preserve one of the last
vestiges of history on Cape Cod.

Although I am not an abutter to the property being considered for construction of the 8' high fence, I do live "across the street"
and see a section of the area, not only from my own property but also from inside my home. The construction of a new fence is
not appropriate for the location.
Because we have accepted restrictions by the OKH to live and/or own property in the district, every effort needs to be taken to
enforce that which maintains its character, ...in this case, out of place structures.
The area being considered is behind a Yarmouth Port home which is the best authentic example of that which is aimed for along
Rt 6A. Because this proposed fence is visible from the sidewalk, other neighbors' properties, Rt 6A itself,the sight plane toward
the Bay will be cut off totally.
Care must be taken to preserve that which we have agreed to maintain by owning property in the district.
For this reason, the permit should be refused.

To the Members of the Old King's Highway Commission:
My old friends John and Barbara Stuart have related to me an initiative by their neighbor to the rear of their
property, to erect an 8-foot tall fence across the back line of the Stuart's lot that would be highly visible, and
visually intrusive, to John and Barbara's home, their visitors, other neighbors, and anyone passing by who would
otherwise enjoy the sight of a 17th-century Yarmouthport historic residence.
The Stuart's home is listed in the National Register of Historic Places, as a place and structure deemed worthy of
preservation by virtue of its historical significance, and rightly so. The house has proven attractive to sightseers,
artists, and photographers who are drawn to it because the house reminds us of a previous age, before
McMansions and Garage Mahals began invading our visual spaces. To deface such a property with a modern, 8-
foot tall fence across the back line, would be a needless affront to what we're trying to preserve in the
Yarmouthport historic district.
Years ago, a neighbor of mine wanted to put up a fence between our two properties, and I persuaded him that a
row of tall, green Arbor Vitae would do perfectly well to define our borders and give us both a pleasant visual
break and privacy as well. That row of dense green trees has stood ever since. The neighbor, with whom I got on
pretty well, has since sold his place and moved on. His fence, had it been built, would still be there, long after the
neighbor and his concerns about our property line are forgotten. Instead, that tall row of Arbor Vitae is now a
daily source of pleasure to the new folks, and to me.
John and Barbara Stuart's back-line neighbor is a person named Krishna Sprinkle, and she has made 'privacy'
her stated motive for wanting this 8-foot fence built. Well, that's as may be. Her neighbors along Rte 6A who feel
some psychological need for more privacy than they already possess, by and large have met that need with
green fences, in the form of high hedges, trees and shrubbery. If Ms. Sprinkle really feels such an urgent need
for privacy, my suggestion is a green fence, of the kind that has worked for me and for others in Yarmouthport.
An eight-foot tall spite fence would be wildly inappropriate in a district whose citizens place a premium on the
preservation of the area's history and character.
As a frequent visitor to John and Barbara's fascinating home and yard, and as an even more frequent passer-by
during walks in the neighborhood, I hope that this old house will continue to radiate its centuries-old charm, and I
urge Krishna Sprinke to find a different kind of answer to her privacy needs.

To the Old Kings Highway Historical District
As a Yarmouth Port resident since 1970 , I 've seen many changes
to our village ; the inevitable passage of time affecting our roads ,
homes and residents .
My letter to you today is in regard to the property at 182 Main
Street - the home of John and Barbara Stuart . I 've known John and
Barbara for 35 years and I 've always admired their commitment to caring
for their authentic and original 1 /00 ' s full Gape .
Being a New England artist of note and a Copley Master, I paint
in the traditional , realistic style and I 've often called the Stuart ' s
home "Cape Gods Motif # 1 . " I 'm drawn to the aesthetic beauty and
architecture of old homes as are other artists-far and wide that have
painted this house. It ' s even been featured in magazines and was on
the cover of Cape Cod Guide .
it takes special people to be stewards of old homes and the
understated and simple beauty of 182 Main Street is a gift to all of
us that see it .
I 'm hopeful that the OKHHD Committee - in their wisdom and good
sense will NOT allow a fence to be an eyesore at a home that ' s the
centerpiece of our village.
