Dear Mr. Gegenwarth,
I am writing you today in response to your letter I received in January, 2018. I am the current
owner of 32 Seminole Drive in Yarmouthport as I purchased the property in 2008. The home
has needed major repair over the years and I have saved and worked to make my home look
aesthetically pleasing to the passerby. As seen below, here is a picture of the property upon
purchase in 2008.
I realize now that I didn't go through the proper channels for approval. I did not knowingly
wish to deceive or intentionally ignore these rules. The numerous fence companies that came
out to give me an estimate told me a diamond rail fence with the capped posts was the best fit
for my desires but never informed me that I needed approval from your board. My intent was to
place a fence in the front of my property to keep people off my lawn but also to add a subtle
detail to make my home look even more like Cape Cod as I see in Chatham, Martha's Vineyard,
and in the many beautiful areas around the Cape.

As you could see, much of the landscape was overgrown and some of the bushes were
housing black water snake nests, some snakes close to 5 feet long. I did keep some of the
landscape materials. Many of the pines were rotted and needed to be removed because they
posed a danger to my home. Over the years, bit by bit, I have tried to update the property. As I
have tried to restore the property, I have kept Cape Cod in mind. I have lived here most of my
life and teach in our town school system.
When considering a fence for my home, I looked at the materials available and how they
would look down the line with our super moist environment. As I drive down Route 6A, I notice
many rotted, half painted fences and notice how run down they look. I also noticed (as pictured
below) many vinyl fences installed at homes within a quarter mile of my home. I wanted to
have a fence installed that would remain pristine in color and structure, offer a Cape Cod feel,
stay clean and offered contrast to the colors of the seasons. In the end, I chose a product that
had a long-standing durability that other materials did not offer. While I understand the board's
idea of a "plastic fence" may be undesirable, I believe many of these materials have been
significantly improved since first entering the market years ago. I also chose a product that was
not pressure treated because I know that those chemicals will leach into our fragile ecosystem
including our groundwater and the pond that is in my backyard.

Another issue I've had to deal with is the property abutting mine. There are raccoons, mice,
and rats coming and going on a regular basis from this home. Perhaps the real issue here I
wish the town would be more concerned with is this home. I am sure they are violating many a
historical code. Last year there was a gas leak discovered by the neighbors which needed
emergency response. There are electrical wires hanging down on the property as well. With
this in mind, I have a desire to maintain the value of my home while living next to this property. I
have a strong desire to put up a fence along my property to help keep the animals out and
because of its unsightliness. The trash you see is not mine and the more I pick up, the more
trash there is underneath. Over the years, I have tried to pick up the trash on the lawn because
there are paint cans and other trash that may be leaching into the soil.

I appreciate you reading my letter all the way through and for your consideration in this
matter. I believe my home, which includes the fence, is not unsightly but a lovely addition to my
neighborhood. My home is no longer cluttered with overgrown bushes but replaced with flowers
and low growing bushes which also allows my home to dry out from time to time preventing
mold and mildew. There is still work to be done of course, but please understand that my desire
to update my home is as important as having it represent to beauty that is Cape Cod. The white
fences, the landscape design, the contrast in whites and historical colors are all part of the
coastal community I chose to raise my family in.

Dear Property Owner(s),
As you are aware,your property being north of Route 6(Mid-Cape Highway)is located within Yarmouth's
Old King's Highway Historic District.The OKH Regional Historic District was mandated under State Law,
Chapter 470 of the Acts of 1973 as amended and is bound by the 972 CMR (Code of Massachusetts
Regulations) as published in the OKH Regional Historic District Commission Bulletin. This Act requires
that all exterior changes and/or additions to settings and structures be reviewed and approved by the local
Old King's Highway Committee prior to work being started.
It has come to the Yarmouth Old King's Highway Committee's attention that a vinyl fence has recently
been installed at the front of your property. Please note that fences require approval from the OKH
Committee prior to installation and more importantly,vinyl fences are not allowed in the OKH District. As
such, you are hereby informed that you are currently in violation of the OKH by-laws for the following
reason(s):
1. Installation of a fence without approval from Yarmouth Old King's Highway Committee
for appropriateness and setting.
2. Installation of a vinyl fence.
To clear this violation, the Yarmouth OKH Committee requests that the vinyl fence be removed within
30 days of receipt of this notice or show cause why you should not be required to do so.
Enclosed are the OKH fence requirements along with the required applications. To seek approval for a
fence,please complete the appropriate application and return it to the Yarmouth OKH office for review.
Please note that failure to comply with the OKH Regional Historic District Act is subject to fines and
penalties as allowed per Section 12 of the Act.
Any objection or inquiry in reference to this notice should be filed before the expiration of time allowed
for the resolution of this violation.
