In the past we spoke about and calculated the side slope but didn’t show it. Then when we got to 91/Corps they asked for it on plans, so now we show the side slopes on all plans. The channel width is always the width of the base of the channel and there is always a side slope to prevent sloughing (this is on all dredging). So the side slope falls outside the channel footprint. In areas where we have salt marsh we reduced the width of the dredging to avoid the SM (minimum 15 feet from SM to side slope). So in those cases the side slope falls within the channel footprint. With dredging we would still permit the full dredge channel and side slope but we will be required to adhered to salt marsh setbacks for each dredge event. So if we have salt marsh today we would keep the 15 foot setback (if approved by the commission). If that marsh is gone in 3 years and we would go and dredge the full original width of the channel (conversely if more marsh grows we would reduce the dredge area as needed). Dredging always falls within the confines of the channel and side slope no matter what. So we can’t move out of the channel to avoid salt marsh along one side of the creek lets say (we would just need to squeeze the dredging into the permitted channel footprint). That’s why it’s impossible to maintain the 25 foot setback to all salt marsh because we wouldn’t be able to dredge the upper ½ of the creek. We won’t be dredging before 12/1 this year. I would ask that to not be written into the OOC for every year because our window to dredge is open much earlier in the fall. This would restrict each dredge event through the life of the Order as this is maintenance dredging. Let me know if you need anything else! I still think the channel width and shading on the plan is a little confusing. What I have figured out – correct me if I am wrong – is that in areas where the full 40 feet width is being dredged the sloughing of the side slope falls outside of the 40 foot wide channel. In areas where less than 40 feet of dredging will take place, the sloughing impacts are within the 40 foot width. In a couple of areas the dredging channel has been moved over to avoid salt marsh. There will not be dredging outside of the 40 foot channel area (as the shading tends to indicate) but there will be side slope impacts outside that area in some locations. When I compare this to the previous permit plans the actual dredging width has been much narrower in the past, so the slope impacts have fallen within the 40 foot wide channel. st Karl advised me they are opening/have opened up the area for shell fishing. I think you were looking at a December 1 start date. I will recommend at start date of no sooner than Dec 1 to allow for the shell fishing. The Commission will still need to agree an allowed distance to salt marsh based on the DMF comments. I have reviewed the COCs and find no problems with issuing those.
