(BSC) is pleased to submit this Notice of Intent (NOI) Application on behalf of Michael Lenzi (the Applicant) for the property located at 8 Grove Street, West Yarmouth, Massachusetts (the Site). The project consists of the raze and replacement of a single-family dwelling with associated deck and pervious driveway, as well as the construction of an inground pool with a surrounding patio (the Project). Portions of the proposed work will occur within Coastal Bank, 100-foot Buffer Zone to Coastal Dune and to Salt Marsh, within 200-foot Riverfront Area to an unnamed perennial stream, and within Land Subject to Coastal Storm Flowage. However, in all Resource Areas and their associated Buffers Zones, with the exception of 94 square feet of disturbance associated with a pervious driveway and inground pool within the 50-100-foot Buffer Zone to Coastal Dune, impacted areas on Site will be reduced as the result of the proposed work. Applications must be submitted two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioner’s packet a week before the meeting. Failure to follow the Administrative Checklist guidelines shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Project Description Notice of Intent 15 Park Avenue West Yarmouth, MA PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project at 8 Grove Street, in West Yarmouth (the Site) consists of the raze and replacement of a single-family dwelling with associated deck and pervious driveway, as well as the construction of an inground pool with a surrounding patio (the Project). This application is being submitted in accordance with the Massachusetts Wetlands Protection Act (WPA) and the Town of Yarmouth Wetlands Protection Bylaw (the Yarmouth Bylaw). 2.0 SITE DESCRIPTION The property located at 8 Grove Street, in West Yarmouth, is bordered by single-family homes to the north and east, by an unnamed perennial stream to the west, and by Lewis Bay to the south. The wetland resource areas and areas of conservation jurisdiction on or adjacent to the Site, that are protected under the Wetlands Protection Act and the Town of Yarmouth Wetland Protection Bylaw include: • Riverfront Area to Unnamed Perennial Stream (RFA) • Coastal Dune • Salt Marsh • Coastal Bank • Land Subject to Coastal Storm Flowage (LSCSF), FEMA Flood Zone AE (elevation 11) and VE (elevation 13) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: Raze and Replace Existing Single-family Dwelling with Deck and Pervious Driveway: The proposed project involves the raze and replacement of an existing single-family dwelling with associated deck and pervious driveway. The proposed single-family dwelling will be constructed on largely the same footprint as the foundation of the existing dwelling. Only a 53-square foot (sf) increase in building size is proposed and will occur within areas currently occupied by maintained lawn and landscaping. The proposed raised deck will be placed over potions of an existing deck and areas of maintained lawn. The pervious driveway will be located on the southern edge of the proposed dwelling and will have two shallow drywells installed to manage stormwater. The proposed work will result in no increased impacts to Resource Areas on site, with the exception of a portion of the 50-100-foot Buffer Zone to Coastal Dune. This will be accomplished through the reclamation of roughly 2,512 sf of areas within Coastal Bank, the 0-50- foot Buffer Zone to Coastal Bank, Salt Marsh, and Coastal Dune, as well as the 0-100 section of the RFA and LSCSF on Site, as well as the removal of an existing garage building. Therefore, no new impacts or significant impacts to Coastal Bank, the 100-foot Buffer Zone to Coastal Bank, Salt, Marsh, and Coastal Dune, RFA, or LSCSF are anticipated as a result of the proposed work. Pool and Associated Patio: The proposed 12-foot by 14-foot inground pool and surrounding patio will be located off the southwestern edge of existing and proposed single-family dwelling. These features will be located outside of the 50-foot Buffer Zone to Coastal Dune and Salt Marsh, and will be located greater than 50-feet from the bank of the unnamed perennial stream. Both the pool and the associated patio will be constructed over existing lawn areas and will not require the development of previously undisturbed areas on the Site. Notice of Intent 8 Grove Street West Yarmouth, MA 4.0 ALTERNATIVES ANALYSIS No Build Scenario: In this scenario, the single-family dwelling with deck, pervious driveway, and pool with associated patio would not be constructed as proposed. This scenario would not only be unfavorable for the applicant, but would also not provide the proposed benefits to the Coastal Bank, 100-foot Buffer Zone to Salt Marsh, Coastal Bank, and Coastal Dune as well as RFA and LSCSF, through the planting native species within the mitigation planting area and the reduction of structures/disturbed areas within the aforementioned Resource Areas. The proposed project will serve to reduce impacts to all aforementioned Resource Areas, with the exclusion of 94 sf of impact within the 50-100-foot Buffer Zone to Coastal Dune and will not require construction within previously undisturbed areas on the Site. Therefore, this scenario would not be beneficial to the interests of the applicant or of the WPA and the Yarmouth Bylaw. Increased Impact Scenario: In this scenario, the total size of the proposed single-family dwelling would expand beyond the current foundation. The size of the proposed pool and associated patio could also be expanded and shifted further from the existing single-family dwelling. In addition, the exiting garage building located 35-feet from the Top of Coastal Bank could also remain in place and the proposed driveway could be paved rather than be composed of pervious materials. This alternative would result in an increased impact to the surrounding Resource Areas and their associated Buffer Zones. These alterations to the proposed project would not be beneficial to the interests of the WPA and the Yarmouth Bylaw, therefore this alternative is not recommended. Proposed Scenario: In the proposed scenario, detailed under Section 3.0, the proposed single- family dwelling would be built largely over the current foundation of the single-family dwelling, and would result in only a 53-sf increase in total structure. This configuration of the proposed dwelling would reduce ground disturbance and would avoid a significant increase in structures within the 100-foot Buffer Zones to Salt Marsh, Coastal Dune, and Coastal Bank, as well as RFA and LSCSF. Further, the construction of the pervious driveway over existing lawn would not result in the addition of impervious impacts to the aforementioned resource areas. The removal of the existing garage and the establishment of 2,512 sf of proposed mitigation planting areas will serve as a significant betterment to the Resource Areas and their associated Buffers Zones. All components of the proposed work, including the proposed pool and patio have been positioned as far as practicable from the aforementioned resource areas and will not impact currently undisturbed areas on site. Therefore, this scenario would be the most beneficial to the interests of the WPA and the Yarmouth Bylaw. 5.0 MITIGATION Before work begins on the site, a line of erosion controls will be installed at the limit of work and will be maintained and remain in place until the site is stabilized. Access for this project will be gained from the upland portion of the site and/or the existing paved driveway/road. The existing single-family dwelling will be demolished, with all removed structural components and debris placed in a roll-off container stationed in outside of resource areas. Any debris getting into the resource areas will be removed as soon as possible. No permanent impacts to resource areas are anticipated as a result of this work. Once the project is completed all disturbed areas of lawn will be loamed and seeded. A mitigation planting area, totaling roughly 2,512 sf, will also be planted within the portions of the property which contain areas of Coastal Bank and within 35-feet from the Top of Coastal Bank.
