Dear Agent Grant and the Members of the Commission:
On behalf of the Town of Yarmouth (Town), Tighe & Bond respectfully requests the issuance
of a Certificate of Compliance (COC) for work conducted in compliance with an Order of
Conditions (OOC) issued on June 14, 2018 by the Yarmouth Conservation Commission for the
rehabilitation of the Baxter Grist Mill Dam. This project addressed dam safety deficiencies,
the effectiveness of the existing fish ladder, and the impact of storm flows to the mill building.
Additionally, slopes along the upstream embankment were armored to protect the mill from
erosion and limited access improvements were completed to enhance visitor experiences.
Construction-Phase Design Deviation(s)
The rehabilitation project was completed in considerable accordance with the approved record
drawings associated with the OOC, with the following minor deviations:
• During the rain received from Hurricane Dorian, the cofferdam at the dam failed and
the actual cofferdam that was installed was smaller than what was permitted. The new
revised configuration resulted in an increase of 70 square feet of temporarily
dewatered area in excess of what was authorized. Of note, the cofferdam failure did
not result in any observable in-stream sediment releases or other adverse effects.
• During construction, some small subsurface changes were made to the planned
footing, and the grades in the tidal pool may have shifted following the change in flow
patterns.
• Some debris and silt were removed from the culvert below Route 28 to address a flow
blockage and there was some regrading on the slope on the south side of Route 28 to
address issues that arose during nighttime flow bypass operations.
• Fencing was added along the fish ladder.
• The sluiceway into the grist mill building was replaced (instead of being modified).
• The location of the west blanket drain outfall was modified (just uncontaminated
groundwater).
• The decorative form liner on the fish ladder and upstream wall was extended to the
top of the wall rather than being ended 6 inches down.
• The original OOC also included work on the sidewalk along Route 28, this work has not
been completed.
Based upon the observations made of the site restoration and ancillary activities, and through
a review of the conditions established within the OOC and site plan, the work was completed
in general compliance with the approved plan of record and OOC. Design deviations
mentioned herein were discussed during construction meetings with the Conservation
- 2 -
Commission's concerns being brought forth by the agent, and we believe they were
addressed. These design deviations did not result in any additional adverse impacts to wetland
resource areas.
Engineer’s Statement
The work permitted by the Order of Conditions issued by the Town of Yarmouth Conservation
Commission for MassDEP File Number SE83-2163 was completed. The following statement
has been prepared in accordance with 310 CMR 10.05(9)(d).
I, Daniel R. Buttrick, a Registered Professional Engineer in the Commonwealth of Massachusetts
(P.E. #48155) hereby state that the work proposed for the Baxter Grist Mill Dam Rehabilitation
Project was completed in general accordance with the Scope of Work submitted to the
Conservation Commission on May 24, 2018 (with the aforementioned minor deviations from the
plans approved under the OOC).
The original OOC, the updated site plans, and the Request for Certificate of Compliance
Application (WPA Form 8A) are enclosed. Tighe & Bond is coordinating with the Contractor to
complete preparation of as-built drawings and record drawings, and we believe that these will
be available prior to the December 17 Conservation Commission meeting. We appreciate your
