Good Afternoon, My name is Jeff Desmarais, I am currently a resident in Yarmouth and I am looking to purchase a lot located at 47 Nickerson Farm Way in Yarmouth Port. When you have a moment, I have a few questions regarding the previously mentioned property specifically pertaining to the wetland setbacks on either side of the property. 1. Based on what I can see from the attached plot plans from 2003, the wetland setbacks are currently 100FT. My question is, can these setbacks be adjusted to 50FT? There is currently a drainage trench from the area marked as wetland on the rear of the property leading to another wetland on the adjacent property. Also, there is approximately 8 ft of elevation drop between the two areas. The bylaw setback for structures to wetlands is 50 foot. The no disturb zone is 35 feet. The jurisdictional buffer zone is 100 feet (area subject to review). The wetlands delineation needs to be less than 3 years old for permitting so it will need to be updated. Also, the drainage ditch does not appear to be shown on the site plan you 1 have. During the building process, are there any additional elements or inspections needed to protect the wetland area? If any, where can I get literature on the practices and requirements. See above links. The Order of Conditions issued during the permitting process includes conditions for protecting the wetlands. Usually this includes erosion and sediment control and preconstruction inspection. A Certificate of Compliance is required after the project is complete to confirm the work was carried out according to the approved plans and the required conditions. 3. During the submission of the proposed site plan for permitting (All pending your answers from 1 and 2) are there any restrictions regarding the septic system and wet land proximity? The septic design must meet title 5 requirements including being greater than 100 feet from the wetland. The health department will review the septic design. Thank you again for your time.
