Proiect Summary
Construction of a new intermediate middle school and associated site work.
Comments
Building:
Project is located in the R401 APD overlay district. Educational uses are allowed by right in the majority the zoning
districts. Station Ave Elementary School is also located on the property.
Proposed plans indicate that additional parking will be added to the front of the property, requiring relief from the ZBA per
section 301.2
It appears that the vegetation is being cleared or partially cleared for the driveway, shotput and field locations. The buffers
in these locations should be confirmed prior to application with the ZBA.
Section 301.4.9 references B1, B2 & B3 lots. This project is located in the R-40 zoning district (residential). The bylaw is
silent on educational uses in residential zoning districts regarding the buffer requirements. It is my opinion that relief may
be required for the proposed clearing from the ZBA. The ZBA can also waive the relief for these buffers as an option.
Electronic message center may require relief.303.3.2 Review of the proposed signage is required.
All construction to comply with 780 CMR and appendant codes.
Community Development and Planning: The modifications to the plans based on comments from the Informal Site Plan
Review (SPR) are much appreciated.
1. Buffers: Although there are still some clearing of existing vegetation to the property lines, additional effort has been
made to reduce these locations and to replant a 20' vegetation along the public ways and to screen the most
impacted neighbors along Haywood Ave. Further comments:
a. Plant Schedule: Consider other tree options besides Pitch Pines, especially for Station Avenue street trees.
White Pines can also grow very tall and it may not be prudent to plant them so close to the Haywood Ave
property.
b. Utilities: The northeastern drainage structure should be pulled back outside of the buffer area to allow for the
plantings shown to be installed without impacting the drainage structures.
2. Sidewalk: An 8' shared use pathway (SUP) from Haywood Avenue to Regional Ave Is preferred for safe access to
the school for walkers. Provide an 8' sidewalk/SUP between the two new driveways, and evaluate including a cross
walk at the western driveway.
3. Pavement Markings: Include pavement arrows for one-way loops throughout the campus.
4. Sign: The school sign is shown as an electronic message board, which are not allowed except for Community
Information Boards (CIEs). There are a maximum of 3 CIBs allowed in town with 2 already installed, one at the
nearby DY High School.
5. Traffic: The Traffic Report is now recommending the eastern driveway be entrance only and the western driveway
have two exit lanes/one entrance lane. The eastern driveway is 26' wide, which may give the impression of being
two way even with added signage and pavement markings.
Conservation:
• State regulations 310 CMR 10.00: wetland on plan may be Isolated Land Subject to Flooding if it meets the
requirement that at least once a year it confines standing water to a volume of at least 114 acre-feet and to an
average depth of at least six inches. Note, per 310 CMR 10.57(2)(b)3. the boundary is the largest observed or
recorded volume of water confined in said area. Isolated land subject to flooding does not have a regulatory
buffer zone. If there is no work within the ILSF, the project shall not be jurisdictional under the state
regulations.
• Local bylaw regulations Ch143: there is a jurisdictional Vegetated Wetland and Isolated Land Subject to
Flooding. Vegetated wetlands have a 100 foot buffer zone. If work is outside the 35 foot no -disturb zone then
a Request for Determination of Applicability should be sufficient for review of the project by the Conservation
Commission. This filing will be under the bylaw only.
• Per the Yarmouth stormwater regulations, the project is exempt if it can be proven beyond a reasonable doubt
to the satisfaction of the Commission to occur in a completely contained watershed that cannot possibly
empty into the Town of Yarmouth MS4 that is hydraulically connected to a Wetland Resource Area. The
applicant shall have the burden of proof in demonstrating that the activity is not subject to the jurisdiction of
these regulations. Please refer to engineering comments with regard to the proposed site drainage.
Design Review: No additional comments.
Engineering: Please see below for a listing of pertinent comments.
General:
• Submit request via email (ALima@yarmouth.ma.us) for addressing to be processed to Engineering
Division.
• Refer to attached as -built for the town drainage on Station Avenue near the proposed western curb
cut to be incorporate in the base survey. Both the catch basin and leaching structure will likely be
impacted and should be modified out of the travel lanes and sidewalk area. Coordinate with
Engineering Division in order to determine the extent of necessary adjustment.
• Retain existing pedestrian crossing signs at Lakefield Road.
• Follow up with Engineering and Planning divisions to discuss state project and upcoming committee
meetings regarding traffic signal.
Parking:
• Verify adequacy of proposed turning radius available to vehicles parking along the west side of the
school administration building.
Stormwater/Drainage:
• Cultec R-360 HD profile view (Sheet C-105.1) has several dimensions which appear to specify inches
rather than feet.
• Avoid the use of rain garden basins for stormwater management during construction. Rain gardens
used in this manner should have fine sediment deposits removed along with surficial native soil in
order to restore infiltrative capacity prior to stabilization.
• As noted in the response comments, provide long-term operation and maintenance plan prior to final
permit submission.
Fire: The only comment Fire had for the site plan was regarding the softer curb on the vehicle access road where
the building was very close to the road.
Health: Not present, applicant to contact the Health Department directly for comments.
Water:
• Applicant to file & obtain a building service connection application upon construction permitting.
