The town bylaw includes a 35 foot no disturb zone (1.09 (4) (d)(3 and 4)) so a variance would be required to approve a
deck closer than 35 feet to the dune. The grounds for a variance are as follow:
The Conservation Commission may at its discretion, waive one or more of these regulations when the proposed work
potentially represents a significant ecological improvement when compared to existing conditions, or will not adversely
affect any areas subject to the protection of these regulations. In addition, the Conservation Commission may, at its
discretion, waive one or more of these regulations when there is an overriding public benefit or safety issue at hand and
there is no feasible alternative to the proposed work.
It would also need to meet the state and local performance standards for coastal dune.

Hi Kelly,
I understand from the owner, Christine Mandara, that you met with her landscaper back in June, to discuss the potential
for deck expansion. I looked at the site last January and approximated the landward boundary of the dune to be 35’
from the existing deck, near the toe of a filled slope created around 2005 when the dwelling was constructed. The

attached figure shows the existing conditions and proposed deck within 19’ of the dune. Before we make a submittal,
would you please provide some regulatory interpretation that would apply for this project?
