They simply replaced the similar structures already in place for many years that were damaged in the October storm and only required small post holes in the sand. We know there are similar structures up and down Bass River. In my application, I would like to include these two lower structures and permit them because I don't want to have to do this process again. Most importantly, I would like to have your opinion as to the likelihood that my application will be approved, as I am not eager to spend more than $5,000 to have the application rejected. O’Reilly & Associates, Inc., Inc. of Brewster, MA to provide the engineering services necessary for the preparation of a Site Plan and Notice of Intent to serve our plans to obtain approval for the bench and boat rack already in place on our beach and replace the boat racks that were removed last summer. The firm was the only one of several firms contacted that is currently available to take on the job. Upon your approval of our plan to hire J.M. O’Reilly & Assocs., I would expect the firm to provide us with a firm date to begin their work. As advised previously, the Commission already expressed support for the bench, they just asked that it be shown on the plan so that we have a complete record of all the structures on the resource area. The approval is required for the other structures. Please note the details of the Enforcement Order. I will need to update the Commission on this as we are already well outside the requirements of the Enforcement Order (i.e deadline for filing). Please provide a firm timeline for receipt of the application. I would also ask the question again as to why the repair of the bench would require an approval to restore only the seat fastened to the supporting posts which were not replaced? I am not able to accept the Notice of Intent at this time as it is incomplete. I have attached a copy of the checklist for the Notice of Intent that lists all the required information that needs to be provided. These can be found on the right side the page at this link http://www.yarmouth.ma.us/1222/Wetland-Protection-Regulations-Other-Inf I have also attached a marked up copy of the WPA 3 Form, indicating where there is information missing. An important part of the application is the plan that shows the wetland resource areas and location and dimensions of the proposed structures. As the filing deadline has now passed, the next deadline is January 7 for the January 21 meeting.
