I understand your procedures but I'm having trouble understanding how I am going to get this certified. It was 15 years ago - I did not own the property, I do not know who did the work. How will anyone know if the spec was accomplished? Would they certify something they did not do? If you know ultimately what was supposed to have been done why can't someone from the commission come out and see if it was done. Is this the extent of the spec? Order of Conditions SE83-1700 include buffer vegetation between the house and the wetland so we will need to resolve whether that work was completed before any new work in this area is permitted. Or is there more to the order of condition? Again, thank you for your help with this. Accompanying the request there should be a statement per the regulations (see below text): 10.05(9)(d) If a project has been completed in accordance with plans stamped by a registered professional engineer, architect, landscape architect or land surveyor, a written statement by such a professional person certifying substantial compliance with the plans and setting forth what deviation, if any, exists from the plans approved in the Order shall accompany the request for a Certificate of Compliance. I will then be able to do a site visit to review the request. I believe I provided the details for filing a Request previously. Would it be possible for the Conservation Commission to send out an inspector to verify that the work was done 15 years ago? In this case this was not done by the applicant. This is a separate requirement to a Certificate of Occupancy required through the Building Department. I did take a quick look in the building file and can see a violation notice for not getting a Certificate of Occupancy also. I don’t know if that was resolved – you may want to speak with the Building Commissioner. 3 The Order SE83-1700 is recorded with the registry of deeds and often these are flagged during the due diligence done when a property changes ownership. The Order is a lien against the property so it transfers with the ownership of the property. The link I provided below will take you to the Building Permit files also if you wish to take a look. Click on the property address at the top and it will list the different department files. I hope this helps. I have been doing some research on this. This dates back to 2005 when the house was built. We just purchased the house in September 2020. Would this have had to be resolved for the original occupancy permit? Are there approvals that did not happen? I am at a loss as to why and how this is outstanding. Any help is greatly appreciated.
