Singer (1938-2020) February 5, 2021 Via Email Yarmouth Board of Appeals 1146 Route 28 South Yarmouth, MA 02664 Re: Wise Living Development, LLC (Petition #4875) 822 & 834 Route 28, South Yarmouth Dear Members of the Board, I am writing to submit supplementary materials as requested in connection with the continued hearing on the above-referenced Petition scheduled for February 11, 2021. The Applicant is requesting a Special Permit to convert the Property to the condominium form of ownership. Attached are the following: 1. Revised Master Deed of the Primary Unit Condominium (redlined and clean copies). As discussed, Section 9(b) has been revised to reconfirm that Primary Condominium Unit 2 may be (and will be) further divided into no more than three (3) additional Units. As set forth in the previously-submitted materials, this legal structure is being required under the Opportunity Zone provisions to make the approved redevelopment fundable by the lenders; 2. New Master Deed of the Divided Unit Condominium in Primary Condominium Unit 2. This document creates Divided Units 2A, 2B, and 2C and maintains the same controls and provisions regulating governance of the Property as in the Primary Unit Condominium documents reviewed with the Board; and 3. New Unit Floor Plans for the Divided Unit Condominium. The floor plans include the total square footage of each of the three Units to be within this building. In addition, the Master Deed of the Divided Unit Condominium references these square footages and percentage interests on Exhibit B. Thank you for your continued review of this proposal.
