The petitioner seeks a Special Permit under § 104.3.2 (2}, to alter or extend an existing single Family home on an undersized lot. The property is located in the R25 zone, and contains approximately 5,850 square feet. The lot is improved with a single family home. The petitioner proposes to construct a 12' x 18' family room addition to the east side of the house. The lot is a comer lot. As a result, both applicable set backs are treated as "front" yard set backs. At the originally scheduled hearing, on February 28, 2002, the attorney for the petitioner requested that the hearing be postponed, so that he could consult with the Building Commissioner concerning the relief needed. The application had been filed by the homeowner, without the benefit of an attorney. The Board noted the presence of abutters and their legal representatives, who intend to voice opposition to the petition. The Board voted to continue the hearing until March 28, 20026 {fin March 28, the matter was scheduled for hearing. However, the Board had received from the applicant a letter, dated March 26, requesting leave to withdraw the petition, with out prejudice. Based upon a letter from the Building Commissioner, of March 27, 2002, it appears that the proposcd addition will conform to the applicable set back, based upon the provisions of §203.5. The petitioner request a Variance from the dimensional requirements of the bylaw in order to legitimize an existing noncomplying lot, and to allow the expansion of the house on that lot. The property in question is in the R25 zone. The lot contains 5,850 square feet, and is improved with a single story cape style home. The petitioner, through Attorney Paul Tardiff, provided the Board with the chronological sequences, which resulted in the present tot size and ownership. The lot had been a 6,750 square feet lot created in approximately 1948. In 1950 the lot size requirement for this zone was increased to 8,500 square feet, rendering the lot non -conforming. In 1957 the then owner conveyed a 12' x 75' strip along the easterly sideline to the westerly abutters, leaving the current lot. This was done without the benefit of a subdivision plan, and rendered the lot noncomplying to the bylaw. The petitioners purchased the lot and house three years ago, unaware of these facts, It was not until they recently applied for a Special Permit to expand the home that these inconsistencies were discovered. The additions currently proposed include the expansion upward, adding a second floor, and the addition to the east for a single story 12' x 18' family room addition. The petitioners represent that the additions would keep the house compatible with those in the surrounding neighborhood, many of which have, in recent years, been converted to year-round homes. Several neighbors voiced their support for the proposed. One neighbor however opposed the addition and the relief requested. Reid, Clerk 2 1 `C E v, I I I I Woudouns, James Robertson, Robert Reeds 'This is an appeal from tie decision of the Building Commissioner, of March 27, 2002, relative to the property at 15 Park Avenue, West Yarmouth. The decision would grant a building permit to allow an addition to the front of an existing single family home. 'The decision is based upon the calculation of the required front -yard set -back pursuant to bylaw §203.5, footnote I (allowing for the averaging of the setback of the adjoining lots). The appeal contends that this averaging provision does not apply to a "comer lot". During the pendency of the hearing, additional information as to the history of the subject lot had come to the attention of the Building Commissioner. As a result, by Ietter of June 26, 2002, the Building Commissioner has now determined that the building permit, at issue in the appeal, will not be issued at this time. As a result of this most recent determination, the appeal of the petitioner is rendered moot, at this time. The petitioner's attorney, by letter of June 27, 2002, requested that their petition be withdraw with out prejudice. Accordingly, a motion was made by Mr. Richards seconded by Mr. Igoe, to allow the petition to withdrawn with out prejudice. All members voted in favor of the motion. The petition is there withdrawn.
