This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection Bylaw. All applications must be submitted two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioner’s packet a week before the meeting. Failure to follow the Administrative Checklist guidelines shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the office if you need assistance. We will be happy to help guide you through the process. Submitting an Application: ______ 1 original application with original signatures (double sided). ______ If the applicant is not the property owner, please submit a signed copy of the Site Access Authorization Form. The owner must be sent a copy of the application on the same day it is filed with this office (proof of mailing is required). ______ 7 copies of the first and second page of the application (double sided) with a comprehensive and detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall document how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Bylaw, Chapter 143, BVW delineation sheets and other supporting information. ______ 8 copies of the plan/sketch, folded separately, right side out with title visible and attached to each application. Provide evidence (e.g., record of date subdivision lot was recorded) supporting the classification above (use additional paper and/or attach appropriate documents, if necessary.) 3/8/2021 Request for Determination of Applicability 151 Ocean Avenue South Yarmouth, Massachusetts PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project is located at 151 Ocean Avenue, (the Site) in South Yarmouth, MA and involves various additions to an existing single-family home, upgrades to the existing septic system, and a proposed patio. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. 2.0 SITE DESCRIPTION The Site of the proposed project is a developed lot with a single-family dwelling located on an existing residential street. The Site is bordered by single-family homes to the north, south, and east with forested land to the west. The wetland resource areas and areas of conservation jurisdiction on the Site that are protected under the Wetlands Protection Act and the Town of Yarmouth’s Wetland Protection Bylaw are limited to Bordering Vegetated Wetland (BVW), FEMA Floodzone AE (elevation 11) and the 100-foot Buffer Zone to BVW. 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: Proposed Additions to Single-family Dwelling, Septic System Upgrades, and Patio – The proposed project involves the construction of additions to the single-family dwelling to be located on the northern and southern faces of the building. An existing shed will be relocated to remove it from the proposed footprint of the additions on the northern face of the single-family dwelling, which will move it further from the 100-foot Buffer Zone to BVW. In addition, the existing septic system will be extended to accommodate for additional need. All of these proposed activities will be located only within Land Subject to Coastal Storm Flowage (LSCSF). The proposed patio, to be located on the southwestern face of the single-family dwelling, will be largely located outside of the 100-foot Buffer Zone to BVW. Roughly 64 sf of the proposed patio will be within the outer limit of the 100-foot Buffer Zone to BVW. No adverse impacts to BVW, the 100-foot Buffer Zone to BVW, or LSCSF are anticipated as a result of the proposed work. 4.0 MITIGATION A silt fence and/or straw wattles will be placed at the limit of work. Roll-off containers will be located landward of all resource areas and will be used to remove all debris from the Site. Any debris getting into the wetland will be removed by hand as soon as possible. All construction will be completed upland of the resource areas caution will be taken to ensure construction byproducts do not enter the resource area. All disturbed areas will be stabilized using grass seed or other appropriate materials immediately following the completion of work.
