When is the meeting? We are operating an essential business between the hours of 9am-9pm Monday through Saturday
on a skeleton crew until the Gov. changes the COVID regulations Since my husband and I are the owners we have to be
there to relieve the employees. There is not much we can do at this point until the quarantine is over except make sure
the landscaper files the appropriate permits when they are able to start as well.

Hi Adriana
You need to obtain permits before you do any work on the property. You need to follow the
requirements of the enforcement order to avoid fines.
Please take a look at these pages for information. http://yarmouth.ma.us/1222/Wetland-Protection-

At the meeting you will have the chance to speak with the Commission about the requirements.

Also, I made all the necessary erosion control fixes immediately when requested. What else would the
fines be for? The landscaping job takes time to plan and choose plantings and create. Are you saying I
can get fined for not having the job completed by a certain time? I don’t think plants can be planted now
anyway it’s still too cold.

Hi Adriana
Your builder is referring to the Building permit process which is not my jurisdiction.
Per the Enforcement Order you have violated the Wetlands Protection Act and the
Wetlands Protection Bylaw. You need a survey plan, a restoration plan and to file a
Notice of Intent for the work. You cannot proceed with any further activity on the site
until you have a valid permit through the Conservation Commission. You need to
engage a professional land surveyor to survey the property and provide a plan with
existing and proposed conditions. You can then use that plan to file the application or
have them do it for you. Please note you are subject to daily fines if you fail to take
action to gain the appropriate permits.

Hi Kelly,
We were just able to get a couple landscapers and hardscape builder to come out and
give us a plan for the rear of the property where we are going to finish the
embankment. He tells me there is no permit needed because they are just placing rock
wall less than 4 feet in height and planting shrubs to retain the grade of the hill that they
will correct so it is not as steep as it is now.
We did what you asked with the erosion control on the embankment and right side of
yard and we will replace the grass that was there along the side that was disturbed.
Each of the landscape companies and hardscaping builder we had come price out the
job all said that they would take care of permitting if necessary. The plan is to make a
dry stack 3.5ft angled wall and add plantings beyond to grade the slope to our
boundary. No one is able to do any work until after May 4th at least, and another
doesn’t even have time to fit us in until June. I have attached a drawing with the plan for
reference.
Please advise.

Hi Adriana
Do you have any update on this violation? Do you a have a site plan and
a proposal for the restoration of the disturbed area? The Enforcement
Order required a restoration plan and a Notice of Intent for the
th
retaining wall by March 19. That meeting was continued to April 16
per the agenda I send out yesterday. The Commission may choose to
begin issuing fines if there is no action.
Thanks
