All filings must be made on Town of Yarmouth forms. Applications must be submitted two weeks
prior to the next scheduled Conservation Commission meeting. No new information may be
accepted into the Commissioner's packet a week before the meeting. Failure to follow the
Administrative Checklist guidelines shall result in an Administrative Incomplete Application and
will not be advertised for a Public Hearing. Contact the office if you need assistance.

NOTICE OF INTENT

PROJECT NARRATIVE FOR PROPOSED RE -BUILDING and ELEVATING OF EXISTING LICENSED
PIER and PLATFORM; RE -BUILD RAMP AND FLOAT
Introduction
The site consists of an existing dwelling and an existing fixed wood pier with platform, ramp and pile -
attached float. The pier system received a Ch. 91 License in 1991 (#2756). The pier, platform, ramp and
float are in deteriorating condition. As well, during higher than normal tides, the pier is overtopped. The
owner wishes to replace the pier system in kind (no extension or expansion), elevating it 2' over what exists.
The Resource areas affected by the proposed project are: Coastal Bank, Salt Marsh, Coastal Beach, Land
Containing Shellfish, Land Under Ocean, Fish Run and Land Subject to Coastal Storm Flowage. Most of
the entire site is within Land Subject to Coastal Storm Flowage.
Per consultation with the Natural Resources Director, no filing is required with the Waterways/Shellfish
Committees.
310 CMR 10.30 Coastal Banks
The Coastal Bank in this instance is a low elevated landform which lies well below the 100 year flood
elevation. The southwesterly portion of the bank is proposed to be stabilized with coir logs (to connect to
the abutting coir logs) and beach grass as during high winds and tides this portion is being undercut. The
slope flattens out toward the northeast — there is no erosion occurring here and therefore no coir logs are
proposed for this section. The upper portion of the bank is heavily vegetated with Rosa rugosa and is
helping to keep the remaining bank stable. The Bank does not serve as a significant sediment source due
to its small size and height. It does serve to protect against minor flooding and storm events, and with the
addition of coir logs can better continue in its capacity to protect upland structures.
310 CMR 10.27 Coastal Beach & 10.32 Salt Marsh
The Coastal Beach is a thin margin of sand, partially vegetated with grasses. It lies landward of MHW and
the Salt Marsh, and extends landward to the toe of the low Coastal Bank. The coir logs will be installed by
hand. Only minor, temporary impacts are expected during their installation. The Beach will continue in its
capacity to respond to (higher than normal) wave activity and extreme high tides. The pier, which will
adjacent to the Beach, will have no impact on this resource area.
To protect the Salt Marsh and lessen any impacts, the design of the pier includes pile spacing at
approximately 12', and the piles shall be driven as closely as possible into the holes vacated by the existing
pilings. The width of the decking is proposed at 4'; the decking elevation will be a minimum 5' above the
highest elevation of the salt marsh and have a min. %" spacing. A sign shall be placed near the mean high
water mark to indicate to the public their lateral passage rights under the pier.
310 CMR 10.34 Land Containing Shellfish, 10.35 Fish Run, & 10.25 Land Under Ocean
The pier will cross over Land Containing Shellfish and Land Under Ocean and is within a Fish Run.
Soundings indicate a minimum of 3' of water at the end of the float at MLW. The replacement 12" pilings
shall be Greenheart. Ideally, the pilings will be placed as close as possible to the pilings being removed.

The piling shall be butt driven and not jetted in below MLW, to minimize turbidity. There shall be no
grounding of machinery at low tide.
A shellfish study performed 2 parcels south of locus in 2019 indicated that there was no significant shellfish
population. Out of 36 observation plots, only 4 quahogs were found and these were in the outer reaches
(100' or so) from MHW. A small number of oysters and some ribbed mussels were observed in the marsh
area and can be easily avoided during construction. The DEP does not map the area as having eel grass
beds.
The minor turbidity from piling installation will have no effect on the Fish Run. The current is expected to
clear the water of any temporary impacts from sediment within the water column. The driving of piling vs.
jetting will minimize sediment disturbances.
This pier will be an improvement over what exists, as the portion over the Salt Marsh will conform to
regulations. By constructing the pier at 5' over the salt marsh, the salt marsh grasses will benefit with the
added light penetration. Also, increasing the decking height above MHW over what exists will keep the pier
from becoming awash at extreme high tides, as is the current case. The soft solution of coir logs will
provide protection from storm damage and minor flooding while not affecting abutters from possible wave
energy impacts.
RARE SPECIES
The pier is not located in a Priority Habitat or Estimated Habitat for state -listed rare species as shown on
Mass. GIS Oliver Maps dated 2017.

In accordance with the second paragraph ofthe Massachusetts General Laws Chapter 131, Section
40, you are hereby notified of the following:

permission to remove, fill, dredge or alter an Area Subject to Protection under the Wetlands
Protection Act (MGL c. 131 s. 40 & Town of Yarmouth Wetland By -Law, Chapter 143 1.
