Following is what I found out: Robin Wilcox prepared a plan for Danny Sullivan, the developer of Minnetuxet Way about 30 years ago and submitted it to the planning department as an ANR (Approval not required- because the lots had frontage on roads already approved by the planning department) and the planning department signed off on this subdivision of 500 Route 6A into two lots. As it turned out, Danny Sullivan was not able to purchase the parcel from the owner so never recorded the approved subdivision plan. This is okay though because ANR approved subdivision plans NEVER expire. As such, if you can obtain a copy of the plan, it can be recorded and that would be the only thing necessary IF Minnetuxet was a public way. However, because Minnetuxet Way is a private way you will need to obtain rights to pass over. Hopefully Danny reserve rights to grant to others. This is something that you will need Paul Tardif to research. If he did then you could approach Sullivan and request the right to pass over to get to your second parcel. If he did NOT reserve the rights to pass on then you would need to wait until such time that the town took the street and then you could proceed (likely a very long wait) So first you need to have Paul research whether Sullivan reserved the rights to grant. Then you will need to approach Sullivan for rights and to see if he has the subdivision plan and is willing to give them to you. Note, if he does not have the plans, then Robin can prepare what is called an "81X plan" which I believe is just a redo of that initial and already approved plan. Apparently this can be done when the lines do not change from the original. Robin tells me that Danny Sullivan lives on South Street in Bass River but is likely at his home in Naples at this time of year. Have fun in Maui and I'll see you when you get back. Prior to the creation of Minnetuxet Way in 1986,the "lot" in the rear of 500 Route 6a had no frontage at all. Also, as a private way,there may not be any current legal access off Minnetuxet Way to this lot which was not created as part of that subdivision. Hope this helps. Lot No. 1 is developed and has frontage on Rt. 6A. I checked the Registry and did not find a plan, nor does the deed provided a reference to a plan. I suspect the lots may have been created by Deed some years ago because the deed details the dimensions in rods and the house was built in 1880, according to the Assessors records. I wanted to check with you to see if you may have something additional. Thanks. Following is what I found out: Robin Wilcox prepared a plan for Danny Sullivan, the developer of Minnetuxet Way about 30 years ago and submitted it to the planning department as an ANR (Approval not required- because the lots had frontage on roads already approved by the planning department) and the planning department signed off on this subdivision of 500 Route 6A into two lots. As it turned out, Danny Sullivan was not able to purchase the parcel from the owner so never recorded the approved subdivision plan. This is okay though because ANR approved subdivision plans NEVER expire. As such, if you can obtain a copy of the plan, it can be recorded and that would be the only thing necessary IF Minnetuxet was a public way. However, because Minnetuxet Way is a private way you will need to obtain rights to pass over. Hopefully Danny reserve rights to grant to others. This is something that you will need Paul Tardif to research. If he did then you could approach Sullivan and request the right to pass over to get to your second parcel. If he did 2 NOT reserve the rights to pass on then you would need to wait until such time that the town took the street and then you could proceed (likely a very long wait) So first you need to have Paul research whether Sullivan reserved the rights to grant. Then you will need to approach Sullivan for rights and to see if he has the subdivision plan and is willing to give them to you. Note, if he does not have the plans, then Robin can prepare what is called an "81X plan" which I believe is just a redo of that initial and already approved plan. Apparently this can be done when the lines do not change from the original. Robin tells me that Danny Sullivan lives on South Street in Bass River but is likely at his home in Naples at this time of year. Have fun in Maui and I'll see you when you get back. An 81X plan is not for subdividing property, it is usually used for perimeter plans. As they are already talking about hiring Attorney Tardif, I suggest they do so now as I do not believe all the information in Michael's e-mail is correct.
