Hi Joshua
While there was an existing access path prior to the violation, vegetation and stability of the area has been damaged by
the placement of the sediment as the area now consists of unconsolidated material that is susceptible to erosion and
wash out in heavy rain and coastal storms. To re-stabilize the area action is required. Installation of jute matting and
coastal tolerant grass seed mix is the simplest and cheapest option for restoring the stability and vegetation. If a public
hearing is required the Commission may require a surveyed plan showing the location of the wetland resources areas
and a certified professional restoration plan for the work. My goal is reach a quick and satisfactory solution. If you wish
to dispute this resolution, I am happy to proceed to a public hearing for discussion with the Commission. The next
meeting is April 15 at 5pm. It is a remote meeting so you are able to attend even if you are not local at the time.

I want to thank you for your time and again apologize for our mistake and remind you that as soon our indiscretions
were brought to our attention we rectified the situation and already paid the $200 fine. I left you a vm earlier today, but
wanted to follow-up with an email as well.
Your latest voicemail requested that we regrade and replant the path. I understand you have looked at satellite images
and have spoken with the property owners (via the contact info I provided you). The current private property chain in
place is brand new, my previous visit to the area in Dec of 2020, it was not there. This is and I assume has been a
pathway access to all the surrounding rental properties and homes in the area for years; from your vm, it seems the

owners confirmed that. When the weather is warm its an active pathway and launch for kayaks. The current state of
the path is equal to if not better to what it was prior to our indiscretion.
In addition to the clean soil we removed from the area, we also removed concrete and other debris that was there as
well. The area is now better then prior to our initial involvement.
Vegetation was not affected and stabilization was not impacted.
The image you showed me shows a green area, but as you can see its not that time of year and nothing is green.
Replanting, regrading, and restabilizing an active pathway may be a good idea, but I hope you understand why we don’t
think that responsibility should fall to us.
I am hoping and requesting that a final inspection is done and the issue be considered resolved and closed.
