(BSC) is pleased to submit this Request for Determination of Applicability (RDA) Application on behalf of our client, Ed Shea of Shea Custom Carpentry, Inc (the Applicant), for a project located at 73 Neptune Lane, (the Site) in South Yarmouth. The proposed project at the site involves a proposed upgrade to an existing single-family dwelling including a stoop and modifications to the second story, as well as the removal of an existing deck and concrete patio, to be replaced with an at grade patio. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection Bylaw. All applications must be submitted two weeks prior to the next scheduled Conservation Commission meeting. No new information may be accepted into the Commissioner’s packet a week before the meeting. Failure to follow the Administrative Checklist guidelines shall result in an Administrative Incomplete Application and will not be advertised for a Public Hearing. Refer to the meeting and fee schedule. Contact the office if you need assistance. We will be happy to help guide you through the process. Submitting an Application: ______ 1 original application with original signatures (double sided). ______ If the applicant is not the property owner, please submit a signed copy of the Site Access Authorization Form. The owner must be sent a copy of the application on the same day it is filed with this office (proof of mailing is required). ______ 7 copies of the first and second page of the application (double sided) with a comprehensive and detailed narrative of the project including existing & proposed conditions, construction sequence, type of equipment, staging locations, drainage and stormwater, erosion controls, invasive species management and alternative analysis. The narrative shall document how the project meets performance standards per 310 CMR 10.0 & TOY Wetland Bylaw, Chapter 143, BVW delineation sheets and other supporting information. ______ 8 copies of the plan/sketch, folded separately, right side out with title visible and attached to each application. Request for Determination of Applicability 73 Neptune Lane South Yarmouth, Massachusetts PROJECT DESCRIPTION 1.0 INTRODUCTION The proposed project is located at 73 Neptune Lane, (the Site) in South Yarmouth, MA and involves various additions and renovations to an existing single-family home and a proposed patio within the approximate footprint of an existing deck and concrete patio, to be removed. This application is being submitted in accordance with the Massachusetts Wetlands Protection Act and the Town of Yarmouth Wetlands Protection By-law. 2.0 SITE DESCRIPTION The Site of the proposed project is a developed lot with a single-family dwelling located on an existing residential street. The Site is bordered by single-family homes to the north, west, and east with Parkers River to the south. The wetland resource areas and areas of conservation jurisdiction on the Site that are protected under the Wetlands Protection Act and the Town of Yarmouth’s Wetland Protection Bylaw include the following: • Land Under Ocean • Riverfront Area to Parkers River (RFA) • Coastal Bank • Flood Zone AE (elevation 11 and 13), Land Subject to Coastal Storm Flowage (LSCSF) 3.0 PROPOSED ACTIVITIES The purpose of this application is to authorize the following proposed activities: Proposed Additions/Renovations to Single-family Dwelling and Patio – The proposed project involves the construction of a stoop on the northern face of the house, modifications to the second story of the single-family dwelling, the removal of an existing elevated deck and concrete patio on the southern face of the house, and the construction of an at grade patio within the general footprint of the existing deck and patio. Overall the project will have the following reduction of impacts: Existing 0-50’ buffer zone 196 sf. Proposed 0-50’ buffer zone 36 sf. (reduction of 160 sf) Proposed 0-50’ buffer zone 200 sf of mitigation planting (salt tolerant native seed mix) LSCSF/0-100’ RFA: Existing 1,146 sf Proposed 986 sf (reduction of 160 sf) Proposed 200 sf of mitigation planting (salt tolerant native seed mix) 4.0 MITIGATION A silt fence and/or straw wattles will be placed at the limit of work. Roll-off containers will be located adjacent to the road and away from resource areas and will be used to remove all debris. Caution will be taken to ensure construction byproducts do not enter the Parkers River. Any debris getting into the river will be removed by hand as soon as possible. All disturbed areas will be stabilized using grass seed or other appropriate materials immediately following the completion of work. In addition, a 5-foot wide 200 sf mitigation planting area, is proposed along the top of the retaining wall. The existing lawn will be tilled and seeded with a native coastal salt tolerant seed mix to extend the existing native buffer zone.
