Dear Commissioners: The Division of Marine Fisheries (MA DMF) has reviewed the Notice of Intent by Stephen Brinkmann, 361 Great Island Road, for after-the-fact permitting of minor modifications to floats and a ramp associated with an existing, permitted walkover structure on Sweetheart Creek in the Town of Yarmouth, with respect to potential impacts to marine fisheries resources and habitat. The project site lies within mapped shellfish habitat for soft shell clam (Mya arenaria) and American oyster (Crassostrea virginica). Subtidal waters within the project site have habitat characteristics suitable for these species. Land containing shellfish is deemed significant to the interest of the Wetlands Protection Act (310 CMR 10.34) and the protection of marine fisheries. Based on the scope of work as currently proposed, MA DMF has no recommendations for sequencing, timing or methods that would avoid or minimize impact at this time. Questions regarding this review may be directed to eileen.feeney@mass.gov. Thank you for the opportunity to comment. Eileen Feeney 1
