Dear Commission Members,
On behalf of our clients, Bass River Property, LLC, Francis Lloyd, J.M. O'REILLY & ASSOCIATES, INC. is
providing the enclosed Notice of Intent and Site Plan so as to address the requirements of the
enforcement order issued September 21, 2020, at the above referenced parcel. As required by the
Enforcement Order, the two racks have been removed from the upper beach area and all trimming has
been halted.
The violation occurred when two pre-existing elevated racks were replaced with new racks along with the
upright kayak rack. The new racks were installed in the same area as the previous racks. Attached are
four (4) photographs of the beach area. The first two photographs show the previous rack locations on
the upper beach area. Please note, for reference, the house in the background in the first photo was
removed in 2013-2014 and reconstructed. The second two photos show the racks which caused the
violation notice. It is my understanding, the Commission in their review of the violation, agreed to keep
the upright kayak rake, but required the newer racks removed.
The attached Site Plan shows the existing site conditions which include the upright kayak rack and a
wooden bench. These items along with the other features, were requested by the Commission so as to
confirm the site conditions as of 2020-2021.
In conjunction with the Notice of Intent and Site Plan for the Enforcement Order, the Applicants are
seeking to receive approval to re -install the previous elevated racks. The two racks are shown on the Site
Plan and are labeled as proposed features.
Wetland Resources:
The parcel sits adjacent to Bass River about a % mile from Nantucket Sound. The wetland resources
associated with the parcel are Land Under the Water (Bass River), Coastal Beach, Salt Marsh, Coastal Bank,
Riverfront Area and Land Subject to Coastal Strom Flowage. The landward resource for the establishment
of the 50 and 100 foot Buffer Zones is the Coastal Bank. Please refer to the Site Plan for the location of
the resources and the associated buffer zones.

Project Narrative:
In discussions with the applicants, the violation was triggered when they replaced the two racks with two
new racks and a kayak rack. The applicants would like the Commission to consider approving the two
previous racks as they are useful items with the historic use of the waterfront, by the applicants and their
family members. The Applicants and a majority of the family members are sailors and do not own a large
motor powered watercraft. The applicants own a small runabout watercraft (motorized). The remaining
watercraft enjoyed by the owners are sail or paddle. For many years, the Applicants have used the water
front for the enjoyment of family and their passion for sailing.
The previous elevated racks allowed the applicants to overnight store the small sailing crafts above the
well established beach grass area on the upper beach area. The two sets of racks are similar in
construction as the previous racks. The racks consist will of a set of 2x6 rails with each rail supported by
a 4x4 post. A total of eight (8) posts are proposed, with each post being set into the ground a depth of 48
inches. All hardware will be galvanized and the wood pressure treated. The racks will be 24 inches above
ground so as to allow for boat storage without disturbing the vegetation. The racks are open to the air so
shading will be minimal. The older photos reflect the lack of disturbance to the vegetation when the racks
where in place and used during the summer season.
The parcel is located in between two existing rock revetment structures. The parcel does not have a
revetment so the applicants are very aware of the beach elevation and potential impacts from the lack of
sand as generally caused by rock revetments on adjacent parcels. The existing salt marsh system area
provides some protection and stability to the beach area. Protecting the salt marsh vegetation and the
vegetation throughout the upper beach area is very important to the applicants, whose family has owned
the parcel since 1938.
In our discussions with the Applicants, the beach area at high tides is somewhat limited given the two salt
marsh areas, as referenced above, on either side of the existing dock. The family uses the waterfront for
primarily sailing within the waters of Bass River and Nantucket Sound. The small sail crafts, when not in
use, are stored above the high tide line. The applicants are concerned that the short term placement of
the small water crafts will impact the vegetation along the upper beach area. Even with the precautions
taken, the Applicants are concerned that over time the vegetation will be disrupted and an impact to the
upper beach area be realized. The proposed placement of the two racks will alleviate the potential of
impact to the vegetation on the upper beach and then ultimately the salt marsh resource.
It is the opinion of J.M. O'REILLY & ASSOCIATES, INC., that the re -installation of the two rack system will
provide the protection to the upper beach area and the associated vegetation. The historic use of the
elevated racks demonstrate the lack of impact the racks have on the resources. The following is a review
and analysis of 310 CMR 10.000, Performance Standards, for Coastal Bank, Salt Marsh, Coastal Beach &
Tidal Flat.

that the Conservation Commission will place notification of this Notice in a local newspaper at the
expense of the applicant in accordance with the wetlands regulations, 310 CMR 10.05(5)(a).

the requirements of M.G.L. G. 131, § 40. Notice must be made by Certificate of Mailing or in writing by

Step 3/Individual Activity Fee: Identify each activity fee from the six project categories listed in the instructions.
Step 4/Subtotal Activity Fee: Multiply the number of activities (identified in Step 2) times the fee per category
(identified in Step 3) to reach a subtotal fee amount. Note: If any of these activities are in a Riverfront Area in
addition to another Resource Area or the Buffer Zone, the fee per activity should be multiplied by 1.5 and then
added to the subtotal amount.
Step 5/Total Project Fee: Determine the total project fee by adding the subtotal amounts from Step 4.
Step 6/Fee Payments: To calculate the state share of the fee, divide the total fee in half and subtract $12.50. To

In accordance with the second paragraph of the Massachusetts General Laws Chapter 131, Section 40,
you are hereby notified of the following:
A. The name of the applicant is Francis V. Lloyd III (Bass River Property LLC)
B. The applicant has filed a Notice of Intent with the Yarmouth Conservation Commission, seeking
permission to remove, fill, dredge or alter an Area Subject to Protection under the Wetlands
Protection Act (MGL c. 131 s. 40 & Town of Yarmouth Wetland By -Law, Chapter 143).
