Ecological Restoration Project Description (cant) ❑ The Project is consistent with the MassDEP guidance entitled Dam Removal and the Wetlands Regulations, dated December 2007, and meets the eligibility criteria set forth in 310 CMR 1013(1). ❑ The Project is NOT consistent with MassDEP's guidance entitled Dam Removal and the Wetlands Regulations, dated December 2007 and meets the eligibility criteria set forth in 310 CMR 10.13(1). ❑ The project will not involve the removal of a dam that was constructed or is managed for flood control by a municipal, state or federal agency. ❑ The project will not adversely impact public water supply wells or water withdrawals permitted or registered under the Water Management Act, M.G.L. c. 21G, and 310 CMR 36.00 within the reach of the stream impacted by the impoundment. ❑ The project will not adversely impact private water supply wells including agricultural or aquacultural wells or surface water withdrawal points. ❑ The project provides for the removal of the full vertical extent of the dam such that no remnant of the dam will remain at or below the streambed as determined prior to commencement of the dam removal project, or if such determination cannot be made at that time, as determined during construction of the project. ❑ The project provides for the removal of enough of the horizontal extent of the dam such that after removal no water will be impounded during the 500 year flood event. ❑ The project will not involve a hydroelectric facility requiring a Federal Energy Regulatory Commission (FERC) license or an amendment to a FERC license. ❑ The applicant has obtained from the Department of Conservation and Recreation Office of Dam Safety a written determination in accordance to the General Applicability requirements prior to submitting this NOI. ❑ If the project is exempt from the requirement to obtain a license or permit under 310 CMR 9.05(3)(n), the project will not have an adverse effect on navigation or on any docks, piers or boat ramps authorized under 310 CMR 9.00. Freshwater Stream Crossing Repair and Replacement (310 CMR 10.13(3)) ❑ The Ecological Restoration Project is a freshwater stream crossing repair or replacement project. In addition to the eligibility criteria set forth in 310 CMR 10.13(1), the project meets all of the following eligibility criteria that will meet the MA Stream Crossing (SC) Standards that is completely described below or in the attached: ❑ The width of the structure will be at least 1.2 times bankfull width to facilitate the movement of fish and other aquatic organisms and wildlife species that may utilize riparian corridors. ❑ The structure will be an open -bottom span where practicable or if an open -bottom span is not practicable, the structure bottom will be embedded in a substrate that matches the substrate of the stream channel and that shall be designed to maintain continuity of aquatic and benthic elements of the stream including appropriate substrates and hydraulic characteristics within the culvert (water depths, slope, turbulence, velocities, and flow patterns). wpaform3a.doc • 4122/2015 WPA Form 3A — NOI for Ecological Restoration Project • Page 6 of 20 Massachusetts Department of Environmental Protection Bureau of Resource Protection — Wetlands Program L11\1 W PA Form 3A - Notice of Intent MasBsDEP File Number for an Ecological Restoration Yarmouth Project City or Town C. Ecological Restoration Project Description (cont.) ❑ The structure will have an Openness Ratio of at least 0.82 feet, or as close to 0.82 feet as is practicable. ❑ The project includes considerations for site constraints in meeting the SC standards, undesirable effects or risk in meeting the standard, the environmental benefit of meeting the standard compared to the cost in evaluating: ❑ The potential for downstream flooding ❑ Upstream and downstream habitat (in -stream habitat, wetlands); ❑ Potential for erosion and head -cutting; ❑ Stream stability; ❑ Habitat fragmentation caused by the crossing; ❑ The amount of stream mileage made accessible by the improvements; ❑ Storm flow conveyance; ❑ Engineering design constraints specific to the crossing; ❑ Hydrologic constraints specific to the crossing; ❑ impacts to wetlands that would occur by improving the crossing; ❑ Potential to affect property and infrastructure; and ❑ Cost of replacement. Stream Daylighting ❑ The Ecological Restoration Project is a stream daylighting project. In addition to the eligibility criteria set forth in 310 CMR 10.13(1), the project meets all of the following eligibility criteria and is completely described narrative below/attached: ❑ The project will meet the applicable performance standards for Bank, 310 CMR 10.54, and Land Under Water Bodies and Waterways, 310 CMR 10.56. Tidal Restoration Project (310 CMR 10.13(5)) ® The Ecological Restoration Project is a Tidal Restoration Project designed to restore tidal flow that has been restricted or blocked by a man-made structure. In addition to the eligibility criteria set forth in 310 CMR 10.13(1), the project meets all of the following eligibility criteria that is completely described below or in the attached: ❑ If the project will involve work in a Coastal Dune and/or a Coastal Beach, the project meets the applicable performance standard(s) at 310 CMR 10.27 and/or 10.28. Yarmouth, MA Project Description and Performance Standards Narrative Sea Gull Road Culvert Restoration Project Project Description Based upon record roadway plans obtained at the Barnstable County Registry of Deeds, it is our understanding that Sea Gull Road was first laid out by the Town of Yarmouth between 1952 and 1956 as a public road, and it is presumed that the road was constructed soon thereafter. The plans obtained at the Registry indicate that the road was constructed across portions of existing wetlands that bordered the southern share of tidal Lewis Pond and resulted in the iso}ation of some existing salt marsh areas located on the south side of the roadway from the tidal flows in Lewis Pond located on the north side of the roadway. It appears that at the time of original roadway construction, the tidal flows were maintained in the two isolated wetland areas by the installation of a 12" diameter reinforced concrete cross -drainage pipe under the new roadway in two locations as shown on the proposed project site plans. The isolated salt marsh areas were observed to be supplied with sufficient tidal flows through the two existing cross drainage pipes to maintain them in a healthy condition, at this time. However, their future condition is in jeopardy if the existing cross drainage pipes partially or completely restrict the ongoing tidal flows to these areas from Lewis Pond. It now appears that the two existing reinforced concrete cross -drainage pipes have been undergoing severe deterioration over the years to the point that the buried concrete pipe wall has deteriorated at several locations along the buried cross -drainage pipe length to the extent that sink holes have been appearing in the roadway pavement at several locations along both cross pipes. The roadway has recently required temporary emergency repairs to patch the pipes and then fill the soil voids and repave the repaired areas. The roadway embankment sail that is lost through the holes in the cross -drainage pipes appears to partially clog the pipes, and new sink holes are anticipated as the concrete cross drainage pipes can be expected to deteriorate further. The existing deteriorating concrete pipes have outlived their useful life and need to be entirely replaced with new durable replacement cross -drainage pipes of the same diameter as the existing pipes to ensure that a total collapse of the existing pipes does not completely prevent tidal flows to the isolated wetlands. Both ends of the existing cross -drainage pipes are bordered by the close proximity of salt marsh as can be seen on the proposed site plans. Special care must be taken during the entire cross -drainage pipe replacement construction period so that no disturbance to the salt marsh will occur. The proposed cross -drainage pipe replacement project is designed to now include a precast concrete wingwall to be installed at the ends of all the pipes to help stabilize the roadway embankment at the pipe ends and to help maximize the distance between the proposed construction work and the existing salt marsh areas at the site. The concrete wingwalls are designed to be located landward of Mean High Water to further reduce encroachment into wetland resource areas at the site. The project includes the temporary insta{lation of a temporary sheet pile cofferdam between the adjacent salt marsh areas and the proposed concrete wingwalls at all culvert end locations as shown on the plans. The proposed temporary cofferdam will protect the salt marsh from any disturbance during the entire construction period and will help maintain a dry trench area for the construction of the new pipe culvert. It is anticipated that the concrete wing walls and pipe culvert installation process will take about two days at each culvert location after which full tidal flows through the new pipe can be reintroduced. Both of the existing cross -drainage pipes just barely pass over an existing 6" diameter water main located under the south side of the paved road, so little change to the existing elevation, grade, or location of the existing cross -drainage pipes is proposed. The existing cross -drainage pipes appear to have provided sufficient tidal flows to the existing salt marsh areas located on the south side of the roadway since the time they were originally installed so no change in pipe diameter is proposed. Such stabilization will include the installation of a biodegradable erosion control blanket and the planting of beach grass and such shrubs as bayberry and beach plum. Performance Standards Narrative The following discussion addresses the eligibility criteria as described in 310 CRM 10.11 6 10.13(5) for Tidal Restoration Projects, 10.11: Actions Required aefore Submitting a Notice of intent Lar an Ecological Restoration Project (2) The proposed project is not located within estimated habitat as indicated on the most recent Estimated Habitat Map of State -listed Rare Wildlife published by the Natural Heritage and Endangered Species Program, (3) The proposed project is not located within a coastal waterbody with a restricted Time of Year, as identified in Appendix B of the Division of marine Fisheries Technical Report TR 47 Marine Fisheries Time of Year Restrictions (TOY) for Coastal Alteration Projects dated April 2011. (4) The proposed project will not affect a diadromous fish run as identified in the Division of Marine Fisheries Technical Reports TR 15 through 18, dated 2004. (6) The proposed project does not propose the dredging of any amount in an Outstanding Resource Water or the dredging of more than 100 cubic yards in a resource Area. 10.13. Eligibility Criteria Lar Restoration Order of Conditions Notwithstanding the provisions of 310 CMR 10.25 through 10.35, 10.54 through 10.58, and 10.50, on Ecological Restoration Project shall be permitted by a Restoration Order of Conditions provided that the project meets all applicable eligibility criteria in 310 CMR 10,13, Ecological Restoration Projects permitted by a Restoration Order of Conditions may result in the temporary or permanent lass of Resource Areas and/or the conversion of one Resource Area to another when such lass and/or conversion is necessary to the achievement of the project's ecological restoration goals. The proposed project will not result in the loss of salt marsh or any other wetland resource area at the site. The proposed complete restoration of the hydraulic connection between tidal Lewis Pond and the isolated wetlands will allow the isolated salt marsh areas to continue to flourish. (1) An Ecological Restoration Project shall be permitted by a Restoration Order of Conditions if it meets all of the following eligibility criteria. (a) The project is an Ecological Restoration Project as defined in 310 CMR 10.04, is a project type listed in 310 CMR 10.13(2) through (7), and the applicant has submitted a Notice of Intent that meets all applicable requirements of 310 CMR 10,12. The proposed project is defined by 310 CMR 10.13(5) and is described in the next section below. The Notice of Intent meets all the applicable requirements of 310 CMR 10,12 as described in this narrative as well as the submitted project description and construction protocol, (b) The project will further at least one of the interests identified in M.G.L. c. 131, § 40, Page 2 of 8 019505.00 :Notice of Intent Town of Yarmouth DPW, Yarmouth, MA The project will further the interests of the existing isolated salt marsh areas located to the south of the existing roadway. (c) the project will not have any short-term or long-term adverse effect as identified by the procedures established by 310 CMR 10.11, on specified habitat sites of Flare Species located within the Resource Areas that may be offected by the project or will be carried out in accordance with a habitat management plan that has been approved in writing by the Natural Heritage and Endangered Species Program and submitted with the Notice of Intent. NH SP review and approval in process. (d) To the maximum extent practicable, the project will: 1. ovoid adverse impacts to Resource Areas and the interests identified in M.G.L. C. 131, § 40, that can be avoided without impeding the achievement of the project's ecological restoration goals; All of the proposed construction activities will be contained within the footprint of the existing roadway embankment and no adjacent wetland resource areas will be allowed to be disturbed by the construction of the project. 2. minimize adverse impacts to Resource Areas and the interests identified in M.G.L. c. 131, § 40, that are necessary to the achievement of the project's ecological restoration gools; and No adverse impacts to wetland resource areas will be allowed to occur during the construction of the proposed project. utilize best management practices such as erasion and siltation controls and proper construction sequencing to prevent and minimize adverse construction impacts to Resource Areas and the interests identified in M,G,L, c, 131, § 40 The construction process will use best management practices and is further described in the construction protocol, (e) The project will not have significant adverse effects on the interests of flood control and storm damage prevention in relation to the built environment (Le., the project will not result in o significant increase in flooding or storm damage affecting buildings, wells, septic systems, roads or other human -mode structures or infrastructure). The proposed project will not have adverse effects on the interests of flood control and storm damage, because the existing supply of tidal waters to the isolated salt marsh areas will be allowed to continue upon completion of the project. (f) If the project will involve the dredging of 100 cubic yards of sediment or more or dredging of any amount in an Outstanding Resource Water, the Notice of intent includes a Water Quality Certification issued by the Department in accordance with 314 CMR 9.010: 401 Water Quality Certification for Discharge of Dredged or Fill Material, Dredging, and Dredged Material Disposal in Waters of the United States Within the Commonwealth, (g) The project will not substantially reduce the capacity of a Resource Area to serve the habitat functions identified in 310 CMR 10,60(2). A project will be presumed to meet this eligibility criteria if the project as proposed in the Notice of Intent will be carried out in accordance with any time of year restrictions or other conditions recommended by the Division of Marine Fisheries for coastal Page 3 of 8 C19505.00 ;Notice of Intent Town of Yarmouth DPW Yarmouth. MA writers, and by the Division of Fisheries and Wildlife for inland waters in accordance with 310 CMR 10.11(3) through (5), As set forth in 310 CMR 10.12(3), a person submitting a Notice of intent for an Ecological Restoration Project that meets the requirements of 310 CMR 10.12(1) and (2) is exempt from the requirement to perform a wildlife habitat evaluation in accordance with 310 CMR 10.60. The project meets the requirements of 310 CMR 10.12(1) and (2) (which is described throughout this narrative as well as the other submitted narratives), therefore the project is exempt the requirement to perform a wildlife habitat evaluation. (h) If the Ecological Restoration Project involves work on a stream crossing, the stream crossing has been designed in accordance with 310 CMR 10.24(10) for work in coastal resource areas and 310 CMR 10.53(8) for work in inlond resource areas, as applicable. N/A. No stream crossing is proposed. (i) The Ecological Restoration Project will not result in a discharge of dredged or fill material within 400 feet of the high water mark of a Class A surface writer (exclusive of its fributories) unless the project is conducted by a public water system under 310 CMR 22.00, Drinking Water or a public agency or outhority for the maintenance or repair of existing public roads or railways in accordance with 314 CMR 4.06(1)(d)1. The proposed project will not result in any discharge of materiai within 400 feet of the high water mark of a Class A surface water. (j) The Ecological Restoration Project will not result in a discharge of dredged orfill ll material to a vernal pool certified by the Division of Fisheries and Wildlife. The proposed project will not result in the discharge of material to a vernal pool. (k) The Ecological Restoration Project will not result in a point source discharge to on Outstanding Resource Water. The proposed project will not result in a point source discharge to an Outstanding Resource Water. (1) The Ecological Restoration Project will not involve the armoring of a Coastal Dune or Barrier Beach. The proposed project will not involve the armoring of a coastal dune or barrier beach. 10.13: (5) Additional EUlgibility Criteria for Tidal Restoration Projects if the Ecological Restoration Project is o Tidal Restoration Project designed to restore tidal flow that has been restricted or blocked by a man-made structure, the Ecological Restoration Project shall be approved by a Restoration Order of Conditions, provided that in addition to the eligibility criteria set forth in 310 CMR 10.13(1), the project meets oil of the following eligibility criteria; (a) if the project will involve work in a Coastal Dune and/or a Coastal Beach, the project meets the applicable performance standard(s) at 310 CMR 10.27 and/or 10.28. The project does not involve work in a coastal dune or a coastal beach. Page 4 of 8 C19505,00 :Notice of Intent Town of Yarmouth DPW, Yarmouth, MA (b) The project will not include a new or relocated tidal inlet/breach through a Barrier Beach or additional ormaring of a Barrier Beach, but may include the modification, replacement or enlargement of an existing culvert or inlet through a Barrier Beach. The proposed project does not include a new or relocated tidal inlet/breach through a barrier beach or additional armoring of a barrier beach. (c) The project will not involve installation of new water control devices (Le,, tide gates, flash boards and adjustable weirs) or a change in the management of existing water control devices, when the existing or proposed function of said devices is to prevent flooding or storm damage impacts to the built environment, including without limitation, buildings, wells, septic systems, roads or other human -made structures or infrastructure. The proposed project does not include the installation of any water control devices. The existing isolated salt marsh areas currently receive tidal flooding that is limited by Mean High Water tidal flows through the cross -drainage pipes. This tidal flow situation will remain intact with the proposed pipe replacement prosect which will control the extent to which tidal flows are provided to the isolated salt marsh areas at the site following the construction of the proposed project, (d) The project's physical specifications are compatible with passage requirements for diodromous fish runs identified at the project location by the Division of Marine Fisheries. Not applicable. Wetlands Resource Areas The following discussion addresses the wetlands resource areas within which the project is proposed. Relevant information from the Preambles that pertains to the project site is provided and each Performance Standard is addressed whether it applies or not. 10.04: Lard Subject to Coastal Storm Flowaft Land Subject to Coastal Storm Flowage (LSCSF) means land subject to inundation caused by coastal storms up to and including that caused by the 100 -year storm, surge of record or storm of record, whichever is greater. The surface of the roadway pavement at the location of both culverts ranges between about EL. 4.0 and EL. 6.0 whereas the 100 -year flood elevation in the same area ranges between EL, 11.0 and EL. 13.0. so the project is situated well within LSCSF. No changes to the existing roadway components or grades are proposed as part of this project. All unpaved areas disturbed by this project will be revegetated with indigenous, salt tolerant plantings. The plans indicate that the proposed limit of work will be kept to as small an area as possible and all construction equipment and material storage is proposed to be maintained within the paved areas at the site at all times. 10.27: Coastal Bench When Coastal Beaches are determined to be significant to storm damage prevention or flood control, the fallowing characteristics are critical to the protection of those interests: (a) volume (quantity of sediments) and form Page 5 of 8 C19505.00 :Notice of Intent Town of Yarmouth ❑PW, Yarmouth, MA The proposed project will not alter the volume and farm of the coastal beaches (salt marsh areas) at the site. (b) the ability to respond to wave action. The Coastal Beach areas located adjacent to the site will still be able to respond to wave action as they currently do since the proposed hydraulic connection work is proposed to be located landward of the Mean High Water line. When coastal beaches are significant to the protection of marine fisheries or wildlife habitat, the fallowing characteristics are critical to the protection of those interests (a) distribution of sediment grain size, The distribution of sediment grain size wid remain unchanged. (b) water circulation, Water circulation will be improved, as the proposed hydraulic connection will allow for flushing of the inner wetland during normal tidal cycles. (c) water quality, Water quality will be improved, as the proposed hydraulic connection will allow for continued flushing of the isolated wetlands located to the south of the roadway. (d) relief and elevation. The isolated wetland areas will continue to receive water elevation changes as frequently as presently exists with an intact cross -drainage pipe (tidal cycles), When tidal flats are significant to land containing shellfish, 310 CMR 10.34(1) through 10.34(8) shall apply. (2) Definitions. Tidal Flat means any nearly level part of a coastal beach which usually extends from the mean low water line landward to the more steeply faring slope of the coastal beach or which may be separated from the beach by land under the ocean, When a tidal fiat is determined to be significant to marine fisheries or the protection of wildlife habitat, 310 CMR 10.27(6) shall apply. (6) In addition to complying with the requirements of 310 CMR 10.27(3) and 10,27(4), a project on a tidal flat shall if water dependent be designed and constructed, using best available measures, so as to minimize adverse effect, and if non -water dependent, have no adverse effects, on marine fisheries and wildlife habitat caused by: (o) alterations in water circulation, Water circulation will be improved, as the proposed hydraulic connection will allow for flushing of the isolated wetlands areas during normal tidal cycles. (b) alterations in the distribution of sediment grain size, Page 6 of 8 C19505.00 :Notice of Intent Town of Yarmouth DPW, Yarmouth, MA The distribution of sediment grain size will remain unchanged. (c) changes in water quality, including, but not limited to, other than notural fluctuations in the levels of dissolved oxygen, temperature or turbidity, or the addition of pollutants. Water quality will be improved, as the proposed hydraulic connection will allow for continued flushing of the isolated wetland areas. (7) Notwithstanding the provisions of .310 CMR 10.27(3) through 10,27(6), no project may be permitted which will have any adverse effect on specified habitat of rare vertebrate or invertebrate species, as identified by procedures established under 310 CMR 10.37 The project is not located within a Natural Heritage Endangered Species Program (NHESP) priority habitat for rare species. 10.32: Salt Marsh 10.32: Salt marshes are significant to protection of marine fisheries, wildlife habitat, and where there are shellfish, to protection of land containing shellfish, and prevention of pollution and are likely to be significant to storm damage prevention and ground water supply. When a salt marsh is significant to one or more of the interests specified above, the following characteristics are critical to the protection of such interests: (a) The growth, composition and distribution of salt marsh vegetation, (protection of marine fisheries and wildlife habitat, prevention of pollution, storm damage prevention); The growth, composition, and distribution of the salt marsh will be maintained by the proposed project, because the proposed hydraulic connection will continue to allow for flushing of the isolated wetland areas, which will continue to allow the natural growth of salt marsh vegetation in those areas, The adjacent salt marsh areas will be protected from disturbance by the proposed construction activities through the temporary installation of a sheet pile cofferdam at the locations shown on the plans. (b) The flow and level of tidal and fresh water (protection of marine fisheries and wildlife habitat, prevention of pollution); and The flow and level of tidal water will be improved through the project, as the proposed hydraulic connection will allow for continued tidal flooding and draining of the isolated wetland areas through the replacement pipe culverts, (c) The presence and depth of peat (ground water supply, prevention of pollution, storm damage prevention). The proposed project will not affect the presence and depth of peat, (2) Definitions. Salt Marsh means a coastal wetland that extends landward up to the highest tide line, that is, the highest spring tide of the year, and is characterized by plants that are well adopted to or prefer living in, saline soils. Dominant plants within salt marshes are salt meadow cord grass (Spartine patens) and/or salt marsh cord gross (Sportina alterniflaro). A salt marsh may contain tidal creeks, ditches and pools. Page 7 of 8 C19505.00 ;Notice of Intent Town of Yarmouth DPW, Yarmouth, MA When a salt marsh is determined to be significant to the protection of marine fisheries, the prevention of pollution, storm damage prevention or ground water supply, 310 CMR 10.23(3) through (6) shall apply: (3) A proposed project in a soft marsh, on lands within 100 feet of a salt marsh, or in a body of water adjacent to a salt marsh shall not destroy any portion of the salt marsh and shall not have on adverse effect on the productivity of the salt marsh. Alterations in growth, distribution and composition of salt marsh vegetation shall be considered in evaluating adverse effects on productivity. This section shall not be construed to prohibit the harvesting on salt hay. The proposed project will not alter or destroy any portion of a salt marsh and will not have an adverse impact on the productivity of a raft marsh. Overall, the project will improve the growth and quality of the salt marsh, because the proposed completely restored hydraulic connection will allow far a natural tidal flushing of the isolated wetland. (4) Notwithstanding the provisions of 310 CMR 10.32(3), a small project within ❑ salt marsh, such as on elevated walkway or other structure which has no adverse effects other than blocking sunlight from the underlying vegetation for a portion of each day, may be permitted if such a project complies with oil other applicable requirements of 310 CMR 10.21 through 10.37. The proposed will have no adverse effects to sunlight penetration. (5) Notwithstanding the provisions of 310 CMR 10.32(3) through (5), a project which will restore or rehabilitate a salt marsh, or create a salt marsh, may be permitted. This project does not include the immediate restoration or creation of salt marsh. (6) Notwithstanding the provisions of 310CMP 10.32(3) through (S), no project may be permitted which will have any adverse effect on specified habitat sites of rare vertebrate or invertebrate species, as identified by procedures established under 310 CMR 10.37. The project is not located within a Natural Heritage Endangered Species Program (NHESP) priority habitat for rare species. The construction start date to occur upon completion of all pre -construction requirements outlined in the specifications and Order of Conditions, as well as any pre -construction requirements outlined during the pre -construction meeting, ON-SITE MEETING: Prior to start of construction a meeting will occur to discuss access and the means of construction with the following individuals represented: Construction Contractor Coastal Engineering Co, Engineer Yarmouth Conservation Commission Representative Yarmouth Town Engineer To be discussed during this meeting; Existing conditions, necessary precautions to be taken by the Contractor Access for equipment and materials to the job site Construction procedure and schedule Necessary past -construction reparations and conditions Procedure for past -construction inspection Traffic Control during the Construction Period PRE -CONSTRUCTION REQUIREMENTS TO BE MET BY CONTRACTOR: Proof and Certification of Insurance Coverage Waiver, Release and Indemnification Posting of DEP sign Installation of erosion control facilities including temporary sheet pile cofferdam ACCESS AND STAGING AREAS The construction access will be from Sea Gull Road, and all construction equipment and materials shall be kept within the confines of the paved portions of the road. The Staging Area shall be maintained within the limits of the paved roadway. EQUIPMENT ON WORK SITE During the course of construction, the following equipment is anticipated to be used in the designated limit of work area: Excavator, Front End Loader, soil Compaction Equipment, Dump Trucks, Paving Machine, and Pavement Roller Hand excavating tools When not in use, equipment is to be stored in the approved staging area as referenced above. WORK COMPLETION Upon completion of the construction, all disturbed surfaces to be ready for re -vegetation as soon as possible. C19505.00, Notice of Intent Town of Yarmouth DPW Yarmouth MA The Contractor is to notify the Engineer for a meeting with the parties taking part in the pre -construction meeting, prior to removal of equipment. INVASIVE SPECIES PREVENTION AND EROSION CONTROL Any invasive species encountered within the proposed work area at the site wilt be removed, and those areas will be replanted with indigenous, salt -tolerant plantings, Prior to the start of construction, the contractor shall install the temporary proposed erosion control and resource area protection items such as sheet pile cofferdam, silt fencing, hay bales, straw waddles, and/or sandbags for erosion control. Upon completion of the construction effort, and as soon as weather permits to meet the first growing season, any unanticipated disturbed areas are to be restored and re -vegetated with native species, All erosion control facilities shall be maintained in place until the proposed revegetated areas have attained full maturity of growth. POST -CONSTRUCTION PHOTOGRAPHS The owner shall suppiy the Conservation Commission with post -construction photographs of the access and staging area, access route, and the project locus, as welt as any final vegetation plantings, Alternatives Analysis Sea Gull Road Culvert Restoration Project Alternative 1 — Reconstruct Existing Cross Drainage Culverts in the Same Footprint (Preferred Alternative) The two existing 12" diameter reinforced concrete cross drainage pipes located at two locations under Sea Gull Road provide tidal flows to two isolated salt marsh areas that were cut off from tidal Lewis Pond when the road was constructed in the 1950s. The concrete pipes are now deteriorating to the point that roadway embankment soil is now entering voids in the pipe under the paved road such that the tidal flow is restricted. The pipes have undergone temporary repairs but need to be permanently replaced to restore full tidal flow to the isolated salt marsh areas. This alternative includes the replacement of each existing concrete pipe with a 12" diameter watertight SDR 21 PVC pipe as shown on the plans. Also included is the addition of a precast concrete wingwall to help stabilize the roadway embankment at all four pipe ends as shown on the plan. Alternative 2 — Continue to Repair the Concrete Pipe as Sinkholes in the Roadway Pavement Appear This alternative involves the emergency excavation of the roadway in the affected areas to patch the concrete pipe and can be expected to occur more than once a year as new voids in the concrete pipe can be expected to appear due to continued deteriorated condition of the pipe. This alternative will lead to temporary road closures at any time of the year for repair of the pipes where the road serves as the only access to the Town's public beach located at the end of the road. This situation can be expected to allow roadway embankment sediment to be carried into the salt marsh areas by the tidal flows in the pipes. Alternative 3 — Do Nothing If nothing is done, the two existing East and West reinforced concrete culvert pipes that carry tidal flow under the roadway from Lewis Pond to the isolated salt marsh areas located on the south side of the roadway will continue to deteriorate and allow roadway embankment soil to enter and clog the pipes which will lead to partial or total interruption of the tidal flow to the isolated salt marsh areas located on the south side of the roadway embankment. In addition, such loss of roadway embankment soil into the pipes will continue to result in the development of sinkholes in the paved road which will create a safety hazard and will require constant maintenance if the situation is not permanently repaired. 1.
