The project RFP was advertised under this address so we kept it in the application. It will be useful because it allows us a means to record the Order at the Registry of Deeds. Based upon our experience, there is no means to record a project located in a road right of way at the Registry. 2. We will apply for a new certified abutters list today and then notify the abutters again. Sarah Cole will file a request today to continue the hearing to the June 3 hearing date to allow us time to receive the new abutters list, notify abutters, and make some edits to the proposed project plans. 3. We did not locate a Chapter 91 License at the Registry of Deeds for the construction of Sea Gull Road embankment fill which was constructed over an extensive area of salt marsh at the site back in the 1950's. It is difficult to research for records at the Registry if there is no property deed to reference. I sent an email to Amanda Lima yesterday asking her to see if the Town has a copy of a license for the construction of the road. The intent of the culvert repair design is to locate the proposed concrete wingwalls landward of MHW located along the roadway fill embankment. The proposed culvert cross sections on the plan show the bottom grade at the centerline of the ditches leading into the roadway embankment. We will add a cross section of the grade of the adjacent roadway embankment to the existing profiles which will indicate that the proposed concrete headwalls are located landward of the MHW line along the roadway embankment at all four locations. We suspect that if there is no Chapter 91 license issued for the road, the DEP will not be able to issue a Chapter 91 license for only the proposed culvert work without addressing the licensing of the roadway embankment. However, if such a license is available for the existing roadway embankment and cross culverts, we believe that the DEP will allow us to request them to issue a Minor Modification Determination for the proposed culvert repair work. The issuance of a Chapter 91 license takes the DEP about one year from the time of application, whereas the DEP is required to issue a Minor Modification Determination within one month of application. We are waiting for the issuance of the DEP file number which usually includes their comments regarding possible Chapter 91 licensing issues. 4. The proposed area of stabilization is quite small at each location, and the intent of the design is to keep the limit of site disturbance very close to the limits of the trenches opened up for culvert pile installation. Most of the sites are presently well vegetated and the intent is to disturb the vegetation as little as possible. We will add proposed stabilization details and notes to the plans. Roger P.
