I think a direct replacement would fall within exemption 10.02 (2)(b)2.q. The repair or replacement of an existing and
lawfully located driveway servicing not more than two dwelling units provided that all work remains within the existing
limits of the driveway and all surfaces are permanently stabilized within 14 days of final grade
From the work description it sounds like you are proposing to alter the grade of the existing driveway which will change
the drainage characteristics so I believe this will trigger review by the Commission. I would recommend a Request for

Ms. Grant, I’m the owner of the property at 43 Shore Road and have been since 1985. My asphalt
driveway is in terrible shape, in part due to just wear and tear over the years and the flooding that
occurs here routinely. I want resurface it and got a proposal that includes installing a catch basin. My
reading of the regulations is that the work doesn’t require a permit, but out of an abundance of
caution I am reaching out to you for some guidance. Can you help me on this, and perhaps we can
arrange to have someone come by and view the area in question? I’d appreciate anything you can do
