HomeMy WebLinkAboutUpdated Narrative 7.8.2021 NARRATIVE FOR RIVERFRONT 15 WADSWORTH LANE, YARMOUTH PORT The parcel of land is in the middle of a 1978 residential subdivision on Union Street, Yarmouth. There is a ditch running through the subdivision from the Middletown cranberry bogs easterly to a man-made pond called Miss Thacher’s Reservoir. The reservoir is used to irrigate Dr. Rowely’s cranberry bogs and empties into Mill Pond and ultimately Follin’s Pond, Bass River and Nantucket Sound. The ditch is at the edge of the parcel and does partially enter onto the parcel. The entire parcel is located in Flood Zone X. Well outside and away from any flood hazard zone eliminating any flood control issues. The majority of the lot is inside of the Zone II of the Union Street wellfield. The proposed septic fully complies with Title 5 and Yarmouth Health Regulations. Because the parcel contains 42,183 sf, the construction of a 4-bedroom house and septic system is permitted by right. This protects public as well as private water supplies and ground water. A fully compliant Title 5 septic system will protect from pollution. The construction of the dwelling will e in compliance with the building code mitigating any storm damage. The fully compliant Title 5 septic system as well as the collection of storm water runoff into drywells will keep the ditch free of pollution sources, thereby protecting shellfish and fisheries located down-stream. As mentioned earlier, the parcel is inside of a residential subdivision with housing on all sides. Wildlife will continue to thrive along the ditch and adjacent parcels belonging to the Conservation Commission. At the time the subdivision was approved, a minimum zoning setback was noted on the plan requiring the construction of a dwelling be significantly to the rear of the parcel closer to the ditch. While this did allow the installation of the septic system in the narrow access further from the ditch and immediate Bordering Vegetated Wetland. Keeping the dwelling close to the setback line does allow a significant buffer to the resources. The proposed dwelling has a full walkout on the resource side to limit the amount of disturbance and excavation close to the buffer area. The area of the house within the 0-100’ Riparian zone is 0 sf. There are 2,847 sf of house & deck in the 100-200’ riparian zone as well as only 1,860 sf of driveway. For a net disturbed area of 4,707 sf, well under the 5,000 sf maximum. There are areas that are being revegetated to limit access and siltation. The 1978 subdivision plan indicated the ditch, labeled “Brook” is actually a good 40’ inside the parcel. The applicant is willing to discuss an easement to the Town as the town as the town owns Lot 14 adjacent to this parcel and was originally intended to wholly contain the “Brook”.
